I have a question about form i-130a

 

Does my wife need to sign the form? she doesnt live in the USA. She lives in el salvador

 

Also with form I-130, do i need to have a seperate form for my wifes son? he is under 2 years old.

Yes if you are a USC.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

I didn’t say she should not sign.

Well, you should have put your situtation in the first post clearly.

 

Of course it’s better if your wife signs the form if both of you are living overseas. 

 

The beneficiary living abroad doesn’t need to sign and mail the form if the petitioner was in the US.

Well, you should have put your situtation in the first post clearly.

You were right the first time, almost.  It's not where the spouse lives that determines whether they need to sign the form.  It's where they physically ARE when the petition is filed.  Of course, they CAN sign the form.  They just are not required to sign or provide a passport photo if they are not IN the USA when the petition is filed.

 

The petitioner "mails" the I-130 package.  If you're going to try to help, be precise enough to be clear.  Your first answer was sufficient.  The OP needs to read and HEED....ALL the I-130 instructions.
