Thanks Marta777.  His I-130 was accepted from February 2019 we received the I-797C   Based on June 2019 visa Bulletin I am seeing where I can actually assembly and submit  required documents  to the National Visa center sometime this month in order  to ensure that NVC has everything ready once his priority date appears in the "final action dates" chart and the GC is available to him.

It's not surprising at all actually. The consular processing is completely bottlenecked, for those of us with spouses abroad. They have to make up for the shortfall. 🧐

please can you explain further,  I really don't understand this post..  My fiancé is Nigerian and we are getting married in August,  does the priority dates applies to Nigerian's as well??  Thank you

They apply regardless of nationality.

Assuming F2A becomes current immediately, your "only" waiting time would be the processing time (just like US Citizens), unless an over-subscription develops again.

Thank you so much for your prompt response..  In essence,  you are saying if we get married in August and we start the process by August it will still be processed like that of a US citizen?

Hi, 

 

My PD is DEC 2018. I received my I-797C  in late December. I have a couple of Questions

 

1. I am panicking ( maybe overthinking ) the process and think maybe I should have sent more documents. So, my question is can an RFE be issued after an I-797C ?

 

2. I understand that since CSC is processing my case, it might take a while for my I-130 to be approved. If as per the news mentioned, F2A becomes current, will that mean CSC will work faster as well ?

 

3. Also, is there any way ( I am desperate ) for me to enter the US and thereby utilize the DOF becoming current ?

From the visa bulletin

 

F2A: This category has become "Current" for July, and is expected to remain so through September. This action has been taken in an effort to generate an increased level of demand. Despite the large amount of registered F2A demand, currently there are not enough applicants who are actively pursuing final action on their case to fully utilize all of the available numbers under the annual limit.  

Once large numbers of F2A applicants do begin to have their cases brought to final action, it will be necessary to establish a date in an effort to control number use within the annual limit.  Therefore, readers should be aware that this “Current” status will not continue indefinitely, but it is not possible to say at present how soon corrective action will be required.

  1. An RFE can be issued at any point prior to approval of the I-130.
  2. The PD becoming current doesn't directly impact the processing timeline at CSC. That said, they do typically try to line up adjudication timelines with PDs, so it is possible they may alter priorities to improve that. But it's just speculation at this point.
  3. Only legal way would be via visas that permit immigrant intent - H-1B, L-1, O-1, etc. You cannot use other non-immigrant visas as a means to immigrate.

Dear All,

 

I am currently in Hong Kong with my husband and I just filed I-130 for him with PD Feb 2019.  I dont' understand the update in the bulletin and does it have any affect to me?  The dates becomes current.

 

My case is with the Nebraska Service Center. 

 

I am not sure that currently is there anything I have to do or I just keep waiting, and should I expect to wait 1.5 years or longer, or maybe there's a slight chance the line is shorter now?  Very very confused.  Would be great if you could help! 

 

He also has a USA travel visa, wondering if we could still travel there with him before I-130 approves?

If you are a US Citizen, it has no impact on you.

If you are a green card holder, it may or may not impact you. When your I-130 gets approved, then the PD comes into play. If it is still current, then your case will proceed. If there is a wait again, you will need to wait your turn in line.

You wait for I-130 processing.

Yes, he can visit the US and return home during the process.

We are getting married with my fiance tomorrow and will feel the I-130 next week. We are already in the US as she has a valid non immigrant visa, what is the estimate for AOS?

Thank you.  Can i make the assumption that on the Visa Bulletin, the first table means the dates of which the I-130 are processing

A.  FINAL ACTION DATES FOR FAMILY-SPONSORED PREFERENCE CASES

 

and the second table means the available of visas (after I-130 approved)?

B.  DATES FOR FILING FAMILY-SPONSORED VISA APPLICATIONS

 

Therefore for my case, as I submitted in Feb 2019, now they are only processing I-130 for July 2017?

 

In another website regarding processing time, I checked for Nebraska Service Center that they are handling May 2018 applications though.  Very confused.  Thanks!
