Will my DL expire 6 days after obtaining it? How to renew?

Hi everyone,

 

Quick recap: filed AOS after coming in on a K1, have receipt # and NOA1.

 

Used to live in the US both as student and Au Pair on J1 visas and had a SS# and USDL for those purposes. My NJ DL however has been expired for too long to just renew in RI so I had to do the knowledge and road tests again. The knowledge test gave me a learners permit valid until the end of my I94 (date June 9th). I have my road test planned for June 3rd.

 

I am going to make the guess that my RI DL will be valid as long as the end of my I94 as well? How do I go about getting that extended? Will the NOA1 for the AOS be sufficient? Any experience from people currently in RI about this?

According to the DL application instructions, only the EAD card, or your I94 is valid for the license, so it would only be valid until the I94 expires. Same here in Nevada, my wife had to wait for her EAD AP card to renew her license that expired when her I94 did. They didn't take the NOA 1 for AOS because it says right on the form this provides no immigration benefits, so no proof of status, but you can try, you might get lucky. An unexpired Employment Authorization Document
(EAD) issued by DHS, Form I-766 or Form I-688B; 
An unexpired foreign passport with a valid,
unexpired U.S. visa affixed accompanied by the
approved I-94 form documenting the applicant's most 
recent admittance into the U.S.;
