Help with filing for spouse visa!

Hello everyone! 

Me & my fiancé are getting married very soon. We got engaged two years ago and applied for a k-1 which was approved but I didn’t travel on it because we couldn’t get married in the US anymore. I got it cancelled in November 2018. We are getting married next month & will be applying for spouse visa right after. 

I have a few questions because we have already started to collect documents to file the case. 

1. Do I have to change my surname? Is it necessary? 

2. Can we apply for a spouse visa? Will it be a problem we cancelled the k1 visa after approval? 

3. Since we live in different countries, we don’t share bank accounts or property etc. would pictures, chat logs, phone logs, passport stamps etc be enough to show evidence of relationship? 

4. Do we have to wait a certain time to apply for the visa? Or we can put it in as soon as possible?

2. No but you'll be probably asked about it. 

3.  US spouse can put beneficiary on the bank account no matter where they live. Also file US taxes as married is good proof. 

4. You don't have to wait.

Hopefully the reason as to why you couldn’t travel here with the K-1 has been fixed. Even with a spouse visa you need to meet the general eligibility requirements. You will have another medical. 

 

You should have better evidence of a bona fide marriage than chat logs and phone logs. Focus on the evidence of time spent together in person so the passport stamps are good. For finances, you can include wills and copies of insurance policies that show each of you as the beneficiaries. You are never to young to think about wills, pensions, life insurance, etc.

I tried all my banks and none allow adding my wife without an SSN.  We did get an ITIN and have filed taxes as married but the banks will not budge until I present her SSN.

But he already filed his taxes in March. Is that going to be a problem?

Thank you! We will include all evidence of us spending time together pre & post engagement and the wedding time too.

Can't do what was not allowed for 2018.  Just should do it correctly for 2019

You cannot produce evidence that does not exist.  Concentrate on other evidence, particularly evidence of time spent together in person.

 

Perhaps more critical is WHY "we couldn’t get married in the US anymore".  Please clarify.

The reason is not something that could be held against us I believe. It was getting difficult for us to keep up with culture and traditions by getting married in the US which was important to both our families. To avoid such complications we chose not to go through that route anymore. 

We are going to put in a statement to explain why I chose to cancel my k-1 and are now applying for CR-1 after getting married next month. Would that be okay?
