Just found out that my case has left to the consulate (chennai, India). Thank God!!!!!!! :thumbs:

Your attorney gives you information contrary to the understanding of this board. You filed a I-129F, right? NVC has the approved I-129F, right? It will go on to the embassy and your spouse will be interviewed for a K3. When the I-130 is approved, it will be retained. Your attorney, if he/she is worth an ounce of salt, should know this ....

NVC got my petition Tuesday and by Tuesday night they'd assigned it a MOS number.

edit: gorockogo1, as I re-read your post, I'm not so sure I'm right. You haven't filled in a timeline, so it is hard to understand your situation, but it seems you have both an approved I-130 and an approved I-129F. And, contrary to most recent experience, it seems you've gotten some requests for NVC for paperwork pursuant to the I-130. It would help if you gave us more information and filled in your timeline. Perhaps your attorney has found a way to keep both petitions in play, even though USCIS says their practice is to send the I-129F on to State for processing and retain the I-130...

I dont have the specific dates, but my timeline is approximately the following:

12/11/06 Filed for I-130

2/28/07 Filed for I-129F

3/8/07 I-129F sent to CSC

5/2/07 I-130 approved

5/18/07 NVC receives AOS Bill

5/22/07 NVC sends bar coded instructions with I-864 and DS 230 package

5/23/07 I-129F approved and sent from CSC to NVC

6/1/07 (estimated) NVC receives I-129F ????

6/1/07 (estimated) Receive bar coded packet from NVC for I-130

7-20 informed that she has cleared medical. Documents not yet forwarded to Embassy, they will not release them to her, saying they must deliver the documents themselves. (Not true. many people had their medical papers @ the interview)

7-21 Missed flight

7-25 Docs recieved by embassy, visa all ready to go

7-27 Visa revieved

7-28 ARRIVED IN USA!! :D:D:D:D:D:D:D:D

I-134 is reserved for the embassy interview. this is if you are pursuing K-3.

Thanks for clarifying your timeline. It makes sense that you have both petitions in play.

If you know the receipt numbers from your I-130 and I-129F, you might want to call NVC and check on status. Email also works.

You may have a few options. The I-129F will go to the embassy and your wife might interview for the K3. If you finish the I-130 process at NVC in time, it will also go to the embassy and then your wife would probably interview for the CR1 instead. If she gets the K3, she could return to her country for the CR1 interview, or you could do the AOS all over again, at increased expense, and then she would get her green card with leaving the USA.

So, you might want to contact NVC and also the embassy to get more information on how they do things.
