Hello guys, i just wanna need some advice for my k2

Timeline

I just got aprroved from nvc case number, my problem is. Do i really need a parental frim bio father consent for my k2. She is an elligitimate child. But surename of father is on birth certificate? What should i do?

You don't need parental consent from the bio father to apply for K2 for an illegitimate child from the Philippines.  Every consul in the US Embassy in Manila would know that the mother (I assume that's you?) has full custody of an illegitimate child.  It's ok even if the father's name is on the child's birth certificate.  No need for you to worry.

The child is 15 years old... the father doesnt want to sign and talk at all. He doesnt challenge me in the court. Maybe i will be the first to challenge him for him to ooen hes mouth... what should i do first in the baranggay?

Thanks for the additional info.  I just asked to confirm that there are no complications with your situation.  Based on what you shared above, looks like there's none.

 

So, no need for you to do anything at the baranggay or in court.  You have full custody of your child.  No need for consent from the bio father for you to apply for K2 visa for your child.

If the child is illegitimate then you so need to do anything at all.

She provided nothing from the father, but he was 5, not sure if the k2 being older makes any difference but being illegitimate denies him parental rights

Doesn't make any difference. My K2 s we're 20 and 9. Went through the whole process with out any problems. My 12 yo never met his father until last year at 17 yo.

You don't need anything from the Father. Just go get the visit and not worry about him. You have the Government laws on your side.
