Request For Initial Evidence (I-485 ) & Income Proof (I-864) At The End Of The Year 2018

Hi Everyone,

Please advise me on this issue. I just received the yellow paper that requires more information about the proof of my current income, the employment letter and suggest me to obtain a joint sponsor. My questions are:

 

1. I received the yellow letter at the end of the year time (December of 2018). If I sent all the proof and documents back to USCIS even on the second day of 2019, would they refuse my  proof because technically, my tax info is not "most recent tax year". In other words, if I sent all the proof and documents back to USCIS on the second day of 2019, would I need to file tax for the year of 2018 and then use that information instead of using 2017 income information ?

 

2. Would my joint sponsor need a letter from his employee ? I have the proof that he has been working at the same company for 7 years and I have all his tax transcripts for the last 3 yrs and his income is sufficient for their requirement.

 

3. I would try to submit all their requested documents. But if I some how missed it, would there be another chance to re submit the proof or it would be only one chance ?

  1. You can only submit what you have. 2018 taxes are not due yet (nor can you file them yet).
  2. Needed? no. Can it help validate his income level? Sure.
  3. They can issue another RFE/RFIE but they don't have to.

I think you are confusing the need to file taxes with the need to show current income.

1. They mentioned in the letter that I will have 87 days (a lot of time) to response so I'm unsure if I have to file tax for 2018 and then request for tax transcript of 2018, then use the tax transcript of three years: 2016, 2017, 2018  and current income 2019 to support for I-864 (currently, I'm using 2015, 2016, 2017 and current income 2018). But from geowrian's answer, I just need to submit the proof of current income in 2018 regardless the fact that I would re-submit the proof in 2019. 

2. I forgot to mention that my dad is my joint sponsor for my wife I-864 application. He filed tax jointly with my mom. His individual income is sufficient to be a sponsor. Would my mom need to sign I-864A ?
