10 years Green Card with First interview !!

Hi folks , 

 

i’m thinking about waiting to file so interview will be scheduled after 2nd anniversary and get 10 years  permanent green card .. this can save more than 500$ for me and also save the stress for another interview! 

 

What do you recommend guys ?

What's your current status and when does it expire? How long until the 2 year anniversary? Is the petitioner a USC or LPR?

 

it's definitely possible in some circumstances. The timing is the hard part..you could file and have an interview in a few months or over 1.5 later depending on local office and luck.

You are free to remain in the US until your status expires to wait to file. Depending on how long it takes to get an interview, you may or may not actually interview prior to 2 years of marriage if you file close to July 2019. I would lean towards interviewing before 2 years based on that timeline and the average AOS timeline, but I certainly could work out.

 

Note that you can't leave the US and return with intent to stay.

can I apply to EAD without fils AOS ? 

I need to work and same time I want to wait to file . Can I do that ?

On what basis would you qualify for an EAD without filing for AOS? Presumably there is none...so you would need to file for the EAD alongside AOS.

Ok I can extend my visa beyond that by the way - my PI Told me he will extend my stay and he can do that - so what you recommend in that case ?

It really depends on what you want to do.

 

The advantages of waiting to file is avoid ROC, which has a decently hefty filing fee, potential travel costs to do biometrics and/or interview, stress of dealing with immigration longer, etc.

 

The advantages of filing now mean you will get a green card sooner, can get an EAD sooner, can become a citizen sooner, slightly more likely to get a green card and stay in the event the marriage breaks down (not implying anything or trying to jinx anything..just providing info), etc.

The costs related to ROC would likely be more than mitigated if you file sooner and get hired sooner as a result.

What is your Field Office? If you're in Jacksonville, FL, you'd have your conditional green card within a few months after filing; 3 to 6 months. If you are in Minnesota -like moi, then you're looking at a good 16 months and up.

If you were to break up / divorce while waiting for AOS to be approved, you would lose your basis for getting a green card. So the sooner you file, the less likely it is that you would break up during the process.

Current timelines for AOS for that field office are 11.5 Months to 29 Months. This means they intend to have 50% of the applications processed within 11.5 months and 90% processed within 29 months.

So I fill now , I can probably get my interview after 2 years by 90% ?

We are in Boston and my wife did AOS it took her about 7 months start to finish but was all done in 2017.   We had a friend who also did AOS in Maine started in OCT 17 - had her interview two weeks ago (almost 13 months).   The process is getting longer but it is hard to say these days exactly how long.   Also, for my friends wife, they field EAD with AOS - she never got the EAD, her interview came first.   We got our EAD about 3 weeks before the interview.   While it is free to file for it together with your AOS - you likely wont be able to use it.   

 

I just did 6 months waiting at USCIS for I-130 approval on a IR-2, that used to be a 3 month process.
