Expedited EAD experiences

I would let them them know it's going to take a bit longer on Nov 8-9, and no sooner.  I agree that, if a company went through the trouble of getting you onboarded, there's little for them to lose if they have to wait a bit.  What's your current status on the expedite?  Is it still the "request was completed" nonsense?

 

I mentioned elsewhere that my expedite request moved really quickly, but I also applied with plenty of time left on my current work authorization (TN, not EAD), so I wasn't under a time crunch.  It looks like recently people's expedite requests have been approved within longer timeframes.  I can't say that congresspeople and governors aren't helpful per se, but mine still haven't gotten back to me so in my case, reaching out was entirely useless.  Just 'waiting' did the trick, but I can feel the stress.  If I had the same timeline as you, I would let my work know a few days in advance that I can't continue (in your case, start) working until this is resolved and to please forward to me any training or onboarding materials I can look at in the meantime while this is sorted out, though I would technically book no time for it (just very eager).

2018-08-28: Expedite request submitted for EAD via USCIS support line

2018-11-21: Last TN expired

2018-12-11: AOS Interview - Card is being produced

2018-12-18: Green Card received

My status on the I-765 is at the second “review was complete” which came after they received my job offer fax. It’s stuck there because of the RFE on the I-485 which resulted in all cases put on hold. Sucks but oh well. I am 99% sure they would’ve approved the EAD on October 26 had it not been for the RFE

09/24 - Package delivered to the Chicago Lockbox

09/28 - Credit card charged for $535 and $1225 

10/02 - 4 texts received

10/09 - received 4 NOAs in the mail

10/17 - expedited EAD request, faxed proof the next day

10/22 - early biometrics walk-in

10/26 - "We mailed an RFE for I-485"

11/3 - received RFE in the mail for missing pages on I-864

11/5 - mailed out response to RFE

I heard that--and don't take this as gospel--asking to expedite the EAD also forces the USCIS officer to review your other paperwork to make sure it's complete, including I-485, so if you were going to get an RFE, you'd get it sooner than later.  So there's that.  A kind of a silver lining.

Yes, I know. My request triggered the review of the entire packet, which is honestly a good thing. At least it will be dealt with now rather than 4 months down the line. I just hope USCIS will get back to working on my I-765 soon after they receive the response to the RFE

It's not just expedites that do this. Any normal case has the I-485 reviewed before they adjudicate the I-765 and/or I-131.

My I-485 status updated to “We received your response to the RFE”. The Congressman is also keeping in touch with USCIS on my behalf. Does anyone know when I should be expecting my expedited EAD from now?

Yes, the intending immigrant's income can be included if it will continue from the same source. The OP only shows F-1 in their profile, so now way to know if it's just F-1 work on campus or if it's OPT. If the former, then they generally won't consider that income. If the latter, I have seen it regularly included with proper documentation that the position will continue.

I wonder why this is the case? The idea of showing income is to see if the person is likely to become public charge. Having income on campus and maintaining it for certain numbers of years means the person is less likely to become a public charge, no?

I'm interested in learning more about this matter, can you point me to a topic that confirms this being true?

I believe the idea is that the job won't proceed for the foreseeable future (as it's limited to the duration of being a student).

 

Some recent threads on the subject:

"For the intending immigrant's income to be included in the household income, it must have been from a lawful source and earned while the indenting immigrant was authorized to work in the United States. The intending immigrant listed on the petitioner/sponsor's Form I-864, Affivat of Support or Form I-864A, Contract Between Sponsor and Household Member, must submit evidence that they were authorized to work in the United States.

Examples include the following:
- A copy of an unexpired Form I-94, Arrival/Departure Record, showing a non-immigrant classification that allows the indenting immigrant/household member to work lawfully in the U.S. Classifications include: E1, E2, E3, H1B, H1b1, H1C, H2A, H2B, H3, I, J1, L1, O1, O1A, O1B, O2, P1A, P1B, P2, P3, Q1, Q2, R1, TC or TN.

- A copy of an unexpired EAD issued by USCIS.
- A copy of an unexpired Form I-94, Arrival/Departure Record, with "Employment Authorization" or similar annotation by port-of-entry personnel. "
