Green card condition removal after spouses death

Hi guys it’s been a while , I’m so confused and need to get somethings right,unfortunately I lost my wife March 24th if this year (it’s been so tough)and I am due for my green card condition removal by December ,right now I know I can apply under waiver but I’ve been official a widower since March ,if I want my status back to single do I need to go through divorce of the death certificate is just enough prove ??????

if widow(er) is a status, that is what you would select. otherwise it is single. divorced does not apply at all. you will need a certified copy of the death certificate.

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

Hello Soft, condolences to you and your wife's family. Debbie is right, you should select the widow option. I know someone who have the same situation and she didn't have any problem with the paper.

Sorry for the bad news the samething happened to me sometimes in 2008. I went through hell but yours is better because you have entered already. I will advice you to google about a widower petition and study and understand it so that you can know how to go about process. Please do not relax and think everything is OK or get a good immigration attorney that knows about widow/widower petition not all the immigration attorney knows the process. Good luck

My condolences. Using an attorney is no excuse to just sit back. You’re doing the right thing by seeking out information yourself. Attorneys have been know to screw up.
