Hey guys

 

Thanks in advance for your help.

I'm about to file my I-485 form, I'm married to a USC and we have been living together for about 8months. I came over as an aupair about two and a half years ago on a J1 Visa,212e does not apply to me. We are now planning to file our paperwork, my Visa has been expired for about 3 months, I need to know what forms I HAVE to file along with I-485, only those that are absolutely necessary as we don't have enough money to file them all at once. 

 

Any help will be greatly appreciated thank you.

This literally tells you everything you need to know.

 

You HAVE to pay for the I-485 and I-130. I dunno much about adjusting from J1 (but technically you are not J1; you're out of status) so you need the I-130 too. Everything else does not have fees.

I-130 is necessary for all spouses of US citizens, whether they are in or out of the US.

He is correct. You need to file for I-485, I-130, I-765, I-131. So that's 1760 for the fee.

This is correct.

Also, I would like to point out that you are out of status and you overstayed your visa, so don’t leave the US until you have completed your AOS, you may or may not be safe with EAD and AP (you could run into issues if you get AOS denied for some reason while away with AP). If you leave, you will trigger a ban and it will take a lot longer for you to come back. I would think twice before leaving even if it’s for a family emergency.

Nah, you don't HAVE to file for i-765 or i-131, they're very much optional.

 

But both are for free when you file together with the i-485, so there's really no reason not to file for those two.

 

You pay for i-130, i-485 and the biometrics.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

No fee for an I-765 or I-131 filed due to an I-485.
