Hi. regarding section 8, "real estate"

 

Can anyone provide clarification as to 8a and 8b, wrt does "own" mean that there is no debt associated with that real estate?

 

Or, if there is a house/property with a mortgage, we should list the approximate market value of the house and property in 8a, and the mortgage associated with the house and property in 8b?

 

We are assuming the latter is the correct interpretation.

 

Is there a current minimum salary and net worth threshold in order to definitively prove that the petitioner can sponsor the beneficiary?

It means exactly what it says: "own". The net value (current value - any debts associated with it) is what will be considered for assets.

 

To count the asset, you would need to 1) show ownership, 2) list the current value of it, and 3) list any debts against it.

For #2, a recent appraisal is suggested. Some COs have used a county tax assessment and/or estimates online, but an appraisal would be optimal.

No. the CO makes the public charge decision based on the totality of the circumstances. Somebody could theoretically make a million dollars and not do this, although it's not likely to be the case.

Other affidavit of support forms (e.g. form I-864) give you the following information: "You must show on this affidavit that you have enough income and/or assets to maintain the intending immigrants and the rest of your household at 125 percent of the Federal Poverty Guidelines".

I would assume that the same baseline is applied to the I-134, even though it is not specifically mentioned on the form or the instructions.

for the i 134 its 120% of fed poverty guideline

There is no "hard" requirement, but some COs go by 100% of the FPL and others want to see at least 125% of the FPL. Either way, the I-134 is only a guideline to help the CO determine the public charge risk of the visa applicant...COs at some consulates don't even request an I-134. This differs from the I-864 where it is a legally binding contract and required b y the INA (although the CO still looks at the totality of the circumstances).

btw the yearly poverty guidelines are found on the USCIS website under I-864p.   You must meet at least that poverty guideline for the CO to consider your current income and/or assets.
