I-751 when to file??? (removing restrictions on green card)

Hey there everyone

 

So a quick question on when to file the I-751 for my husband. I had thought it was 90 days before our 2nd wedding anniversary, but was looking at the instructions and it says "you must file it during the 90-day period immediately before your conditional residence expires.". So I am a bit confused, because I thought you had these conditions when you get a green card before you have been married for 2yrs. 

 

Here is the timeline:

Married - 10 Nov '16

Entered with Green Card - 18 July '18

Current green card valid through 18 July '20

So do I apply now which is 90 days before our 2nd wedding anniversary on 10 Nov '18

or

Do I apply 90 before the 2nd anniversary of when he entered which is around 15 April '20????

 

I am really confused

Your wedding/marriage anniversary has nothing to do with USCIS. The date that matters is the green card's expiration (July 18, 2020). File I-751 90 days before THAT date.

gosh darn it, thanks mate. That means the fee will probably be double and I have to remember to do it in 2yrs....

Yeah it's a little confusing because they use the word "anniversary". I should clarify: your marriage anniversary does matter but only for USCIS to decide which permanent residency status to grant. Had your spouse entered the US after your 2-year MARRIAGE anniversary, he would have been granted the 10-year unconditional GC. But that is moot as he entered before that date and has the 2-year conditional GC. After that, marriage anniversary does not mean anything to USCIS. It's all about the expiration date on the GC.

You'll be removing "conditions" not "restrictions".  Maybe put a reminder in your calendar but if you keep the address up to date as required, USCIS will remind you.
