I filed my VAWA in August 2017 and my attorney told me that I can not apply for EAD until VAWA gets approved so I was waiting till I found out here in this form that I can apply for EAD through i485 C9 while waiting for VAWA so I applied for I485+EAD together on May29th did biometrics and still waiting! it has been 5 months since I applied for EAD I don't know if it was taking so long because I didn't send VAWA+EAD+I485 together or if it is something else:( I hav been with no job no income no driver license all my identifications are expired for almost a year! if anyone has any suggestions for me please do let me know I appreciate all your help. 

EAD can take up to 5 months.

Good Morning All,

 

I hope everyone's day is going great.

Please I have a quick question: does USCIS give out information about VAWA applicants or application status over the phone? The reason I'm asking is because yesterday in court, my ex-husband's attorney asked for the name of my immigration attorney and the judge asked me to answer the question which I did and I'm worried that she may try to impersonate my attorney over the phone in order to find out information directly from USCIS. My attorney is in court, but I have emailed to let them know what is happening, but I'm really worried. My ex and his relatives are trying to get custody of my children by trying to get me deported and they are trying every single thing, apparently him withdrawing his immigration sponsorship for me was not enough, for him, it's either he controls me for the rest of my life or figure out how to get rid of me. The way him and his brother were staring at me in court yesterday, especially his brother (his senior brother has been dependent on him financially for so many years, over 23 years now, so the way his brother sees it, my children and I are in the way), he looked like he could kill me, I was scared but had to maintain my composure, I didn't want them to feel that they could intimidate me.

I'm really worried because I know they will call USCIS to try to get information about me.

They want to intimidate you, don't allow them have peace, USCIS will not disclose any information to anyone other than you and your attorney in writing not over the phone ! If you are being Represent by an attorney your ex-husband attorney have to communicate with you representative not directly to you is protocol, and your attorney have the right to denied any  communication on your behalf your case is no one concerns, Remember in VAWA case you are your own petitioner, is all YOU. Proving an abuse to received an immigration benefits without needing your abuser.

USCIS will not even disclose information over the phone to the petitioner or attorney as there is no way to verify that it’s them. USCIS will only communicate through writing about VAWA cases and only to the mailing address that was provided on the petition.

Also USCIS knows your abuser’s identity from your petition and they will not take anything into consideration he tells them.

Thank you so much. You are right, they were trying so hard to intimidate me, because they know after the divorce is final he has to pay me some money that he has been hiding from me during our many years of marriage and also pay child support for our 2 young children, so yes they are for sure trying to intimidate me into dropping my counter suit. I promise you, I will not give them peace, he will pay every cent he owes me, all the money he withdrew from the account without my knowledge which are considered fraudulent withdrawals as he did not ask my consent before withdrawing the funds for his own use buying himself $5000 suits from Tom Ford that he claimed he needed for work while the children and I bought clothes from Walmart and he was living in my house rent free mortgage free. I can't wait to be free of him, God please I want this divorce finalized so I can breathe and focus properly on my children and my career.

I meant Have Peace in your heart during this process, don't let them control your emotions anymore. This is why VAWA exist for us to  be free of any kind of abuse by proving facts and true. Everything will be fine.. Don't worry.

They disclose over the phone with the attorney but the person has to know the case number,that being said if they try to impersonate your attorney they will not succeed at all without having your case number.

Hi Everyone! My lawyer just received a mail for RFE. It says that they need my police clearance (I already have it with me) and evidence that I married my abuser in good faith. We already submitted our joint tax return from last year, life insurance, affidavits from 2 of our room mates, photos from our court wedding and random photos with me and his son, I think it's just a total 20 photos. What other evidence should I submit to prove our marriage is bona fide? @sandranj @iwillsurvive
