I'm not really sure but the first place I would look at is the DS-260 and of course the CR-1 application to USCIS and see if those questions are asked. If I were a betting man I would say yes to the criminal background. The waiver I am not well versed in so I will leave that to others.

The I-130 only asks if you have filed a petition before, no waiver requirements.

 

No criminal background questions.

My answer is to the OP question  below. It doesn't say form I 130.

The CR-1 visa petition (I-130) does NOT ask about criminal background like the K-1 (I-129).  The CR-1 petition starts with the I-130 form.  

 

It does ask if you filed before but there are NO criminal background questions as you are already married and IMBRA does not apply to spouses.

 

As a clarification, the PETITIONER does not have criminal background questions.  The BENEFICIARY will need police reports.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

They do not ask for a criminal background on a CR-1 like they do on a K-1 since spouses are not covered under IMBRA.  I have been looking VERY closely at this. 

 

They do not ask for a waiver for multiple filings of spousal visas.  

 

They do ask if you have filed before.  They do require police certificates from the beneficiary.

I am not upset with anybody answer, you are the one who has a problem with my answer, So far the OP has not said anything about my answer, let the OP make that decision not you.

Decision?  It was a yes and no answer and you answered incorrectly.  Are we supposed to wait for him to question you or should we give him good information.  Don't take it personally.  It was not an attack.  The OP deserves the correct answer.  At that point they can decide what additional questions, if any they may have.  

 

Giving incorrect information to any question should be challenged here.  I have actually been accused of giving the "worse answer in the history of the world" on this site by a moderator.  While that was a misunderstanding, I did deserve to get slapped because at least one person did not thoroughly understand my answer.  I clarified what I actually meant to say and we moved on.

 

Your answers to the OP were wrong.  We wanted them to get the correct answers.

 

Sometimes lurkers have the same questions.  If we don't challenge wrong answers then the misinformation can be multiplied.
