Hello members. Please is it true when you enter America with 10yrs spouse visa and you stay in America for 10 months and you go to Ghana for 1 month holiday and returning back to America  will you refuse to Enter in America at port of Entry. Am little confuse a friend told me this story.

There is no “10 year spouse visa” but if you enter on a spouse visa, you become a green card holder when you enter. It is perfectly ok to visit elsewhere for a month a year.

Don't listen to friends all the time. Friends can be wrong! 

 

One month holiday after a green card is no problem. 

I-751 journey

 

10/16/2017.......... ROC package mailed

10/18/2017.......... I-751 package received VSC

10/19/2017.......... I-797 NOA date

10/30/2017.......... Notice received in mail

10/30/2017.......... Check cashed

11/02/2017.......... Conditional GC expired

11/22/2017.......... Biometrics completed

There is no "10yrs spouse visa". Only 10 years "green card" for spouse. Visa is valid in 6 months only.

When you enter US the first time, the CBP officer will stamp your passport with I-551, temporary green card, which is valid in 1 year.

Then they will send you a physical green card to your address in US.

 

With a physical green card or temporary green card,  you can leave the US within 1 year.

 

- If you leave the US less than 6 months, there is nothing to worry about.

 

- If you leave the US more than 6 months, CBP officer may ask you why did you left the US so long.

Just tell them and they will let you go, nothing to worry.

 

- If you leave the US more than 1 year, you will lose your LPR status, CBP will deny your entry.

You have to apply for re-entry permit, Application for a Travel Document (I-131) before leaving the US if you know that you would leave the US more than 1 Year.

 

Back to your question, the answer is False. Your friend was wrong.
