I-864 : can i sponsor?

Hi,

 

I'm trying to sponsor my wife in the i-130/i-485 packet and was making sure I was eligible to sponsor and that I'm doing it correctly.

 

I've never filed tax returns, since I was a full time student. But, have since held a full time permanent position (almost four months). Therefore, my supporting documentation is as follows:

-Pay stubs from my employer

-Job offer letter

-Bank account statements showing my balance and direct deposits from my job

-Letter from my employer stating that I will be working there for the foreseeable future (in the process of getting this)

-Letter stating that I have never filed tax reports due to being a full time student and not earning enough income to meet the filing threshold

 

My main question about all of this..

Do i qualify to sponsor even though I have never submitted a tax return? My annual income is set to be well above 125% of the Federal Poverty Guidelines.

And, if I am able to sponsor, will i need a letter of Non-Filing from the IRS? (my parents included me as a dependent in years prior, but will not this year because I will have a steady income)

I take that to mean it will be above poverty guidelines - does that mean it's not currently? I don't believe your future income will be a factor - it's your current income they care about. If you do not currently meet the Federal Poverty Guidelines, you will need a co-sponsor, regardless of the reasoning for not meeting income requirements. For example, sending something that says "I don't currently make the income level, but I've accepted a job which I will start on [future date] and my income will be [salary]" will not likely be sufficient (someone correct me if I'm wrong).

 

You can still include all of the things you have listed, as someone already mentioned you would still be considered the primary sponsor, even with a co-sponsor.

Sorry if you misunderstood my question. For the last four months I've been working a job that has an annual salary that exceeds the Federal Poverty Guidelines. In the past four months I haven't earned the 125% of Federal Poverty Guidelines, but annually I will. As I was reading the forms it stuck out to me that annual income was what matters most?

Ah, I follow you now. You are on point - I think you would still need a co-sponsor, in that case. But having the job already with a projected salary definitely does no disservice to you. Again, I would still include the documents you mentioned in your original post even with a co-sponsor.

Does she have a job in the US? Does she have any assets like saving accounts, house...?

I just feel like they will definitely ask for a co-sponsor.

Until then, apply away. The form asks for current income which you have.

She's had a job through the University for 14 months now. The wages have totaled under 8k , so don't believe it will be significant.

That's a good thing. Every single penny counts. They want to know if she will be like to become a public charge or not.

So, you should add her income to the affidavit and she needs to fill out I864A, get a letter from the school confirming her employment history and current salary... as detail as possible. Also attach her pay stubs for this year, tax transcripts over the last three years.
