GM, I just have a question my husband and his daughter were approved after he came to america we got married and had the interview they gave him a 2 year temporary visa. What is the next step he has one more year than it expire. We are not doing the best so need some answers.

He has a two year conditional green card---not a temporary visa.

His next step is the Removal of Conditions.

 

Not doing the best, as in "headed for separation/divorce?"  If so, there may be some issues with him getting the ROC approved and receiving the 10-year green card, (although he can file with a divorce waiver) but without further details hard to give better advice on that circumstance.

 

If you mean "not doing the best" as in not sure of what steps you need to take---read the link @Roel posted and come back with any specific questions you have afterwards.

Yes, I am very unhappy. I want out he said no divorce but I want to leave the relationship and is working on it now. So he wants to send his daughter back to jamaica so he can go to truck school I refuse to watch her so dis respectful to me. I told him she go home she may not get back

You have to look out for you. If you are unhappy you have options also. The decision is not all his. You can try to seek counseling to work things out or if you really want out you can seek counsel from divorce lawyers.

 

No surprise he says "No divorce" because he may know it will complicate things for him regarding immigration down the line.

Thank You I have done so much for them both and I do not fell appreciated. my son and his daughter DO NOT get along I feel we through them in each other lives and it has complicated our relationship. I have done a lot for him hes lazy as hell hes boring. I could go on and on. Could he do it with out me? I dont want to have anything else to do with immigration. I am looking for a place now . I told him I want to leave he does not say anything I feel he does not care. 

 

I'm so stressed. The daughter is 6  and she talks to me disrespectful and she doesn't obey me and he does not have my back she embarrass me in public. Its crazy. I have folks saying I need to think about me and my health.

You should remove yourself from the situation as soon as you can. If the marriage is over, don't worry about his issues with immigration. Yes, he can still go through immigration without being married with you. It just won't be as easy as if you two were to remain married. He would have to file waivers and such. If you two were to remain married it would an easier process for him to go through which is why he is saying no divorce. It is good that you are thinking of your child also.

 

If you divorce, the only thing that will still tie you to immigration is the Affidavit of Support you signed when he did the AOS. Divorce does not removed you from the obligations of that form. But that is only he becomes a public charge. Otherwise, it will be his problem going forward.
