AOS filing - ESTA Expiring soon

Hello,

 

I'm filing for my AOS soon, I've overstayed and have been married a year to my wife. Neither of us expected this last year and as it just happened. Financially it's been hard to keep up the funds to apply, as my wife has been supporting me this last year, hence now being overstayed for a year.

 

However, today I get an email stating my ESTA (which I came to the US on) is expiring next month.

 

My 2 questions are;

1) Do I need to first take my medical exam BEFORE filing my AOS, or can I take it afterwards and take my sealed document the doctor gives me to the interview? This has been one of the crucial financial struggles we've had.

2) What exactly are all the documents I need to file an AOS for? There's so much information out there, I struggle to know what I'm doing.

 

Any help is grately appreciated. Sorry for having "noob" questions.

Check the guides here on VJ and then ask questions. All info about documents is there. 

 

And you need to include medical stuff in your AOS packet.  At least that's what I've done. 

 

Don't worry about your ESTA.  You said you overstayed already so your ESTA is already gone forever.

If you're still overwhelmed after reading this then maybe you need to find an immigration lawyer.

Just read everything carefully and read instructions for each form and it's really simple.

OP - you can mail in your AOS package WITHOUT the medical exam form, that is allowed. You will have the opportunity of taking it along to your interview when you get to that stage or respond to an RFE if it gets issued before the interview. 

 

Since its its going to be a while before you’re called in for your interview, I suggest you don’t rush and do the medical exam immediately after sending in your AOS package as you don’t want it to expire by the time you’ll have to submit it.

Take a deep breath. Anything new is going to seem daunting and overwhelming. The good news is that AOS is pretty straightforward and is a well-traveled path.  The forms you will need to fill in are I-130, I-130A, I-864, I-485, I-765,  and I-131, with supporting documentation. Once you've read the instructions for each, it will become a more straightforward process, you can come back here for any clarification questions.
