It’s hard to believe that I’ve gone from celebrating our successful CR1 and POE to planning ahead to ROC.  I am considering selling my current home (due to buying in the 2007 bubble and just want out since I’m not upside down).  Should I add his name at this point or is it moot?

 

He’s on my health and dental insurances, life insurance, bank account.  We’ll have 3 years of joint taxes by then.  Credit cards need to be updated.  Living wills within a few weeks. Utilities this week, in cases we’re here a few more months.

 

Car is still N/A as he wasn’t licensed and will be learning for a bit. Of course it will change once he’s licensed.

 

My main question is the property whether to add him now or if it won’t matter if we don’t plan to stay.  I want to go with good documentation.  If there’s anything else you recommend, let me know.  I just want a good history with continuity of 1 year + of anything I can.

We are going through ROC now and in a kinda similar situation. I purchased our current home 15 years ago. The title company said it's an unnecessary expense to add my wife's name to the deed because in the state of Texas she is entitled to 50% of the house the day we got married. 

Also, another thing to consider is the mortgage company, if you have a mortgage. You will have to get in writing from them that it is OK to add your spouse to the deed or they could easily demand full payment of the balance if they find out you added a spouse. Highly unlikely, but they have a legal right to do so.

 

I explained all of this in the cover letter. Fingers crossed it will be OK.

 

Our evidence is strong like yours, Medial/Dental Insurance, bank accounts, credit cards, tax returns, wills, powers of attorney, etc. 

 

so the moral of my story, I wouldn't worry about adding him to the deed because you seem to have strong evidence. 

 

The Guide on VJ for ROC had a line that I felt a little more at ease;

"On the "don't panic" front -- ultimately the burden of proof is on the CIS to show a fraudulent marriage. Even if CIS denies, the application can be renewed in front of an Immigration Judge (IJ) in Removal Proceedings -- and the IJ's tend to APPROVE those cases."

Don’t worry about it.  We sailed through with only one name on the deed.  It is more common than you think.  

 

Just be be honest about it in your cover letter.  And be sure your spouse’s name is on your homeowner’s insurance.
