8/14/17 --- AOS sent I-485, I-765, I-131

8/16/17 --- AOS Packet received Chicago USCIS Day 0

8/21/17  --- Received email & text notification 

8/23/17  --- Received hard copy of NOA  

9/01/17  --- Biometrics letter notice for I-485 & I-765 & I-131  

9/11/17  --- Biometrics Appointment Done

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

2/26/18  --- USCIS Mobile Status changed to "Card was mailed to me"

2/28/18 --- Permanent Resident/Green Card received :jest:

employers in my field are not willing to even offer an interview if we don't have a work authorization and the ability to start immediately. If we indicate we waiting on one, we get rejected right a way. So we are not able to get an offer letter. Not sure if that is a good enough answer to USCIS.

Try to get an actual email/letter from a HR department contact on linkedin or maybe a recruiter in the field. Does USCIS know your i94 is expired now that you are no longer F1 status?

No, generally speaking no job offer = no ground to expedite.

not sure what you mean by does USCIS know, we filed this application last year, one semester before school finishes.

I would suggest trying to get proof texts/emails/webpages/linkedin whatever that shows you cannot get to a full "offer letter" before you get your EAD. Then gather all the financial loss proof you have as well. 

Then get your spouse, not yourself to call USCIS and get an understanding of the situation. Your spouse will then need to remind them patiently that your i94 is expired and you need them to work towards expediting your case, then you need to explain the proof you have so on so on.

 

USCIS is so busy that yes beleive or not may have actually said, "well this person is just going to be sponsored and has no job offer so no big deal". But again build your evidence and case first before you call or they will not listen to you. Again USCIS is super busy. 

 

Oh btw, the congressman is super busy as well fighting the busyness of USCIS. So without all that and a case they will want the same. Also again your spouse may need to be the main one going to see the congressman and speaking beside you.

 

Fun times, indeed.

So why does my previous status affect this? F1 and I-94 expiration?

They are overwhelmed with applications, simply put someone with a a K1 has a direct paperline to how their process work. Someone with H1B is just ignored since they have full status till interview. 

 

Their priority is around people who do not have status at all and their i94 has expired. Potentially when someone first started to look at your case thought maybe this perosn has 2 more years to graduate, okay bottom of pile they got status till i485 interview. Remember everyone is applying for their EAD/AP and they are overwhelmed.

How do you know this? How do I correct this if it was indeed the issue?
