DCF In Mexico.

I am nearly done with ds-260. I only have work history left to do. My wife worked for a month in Colombia at a restaurant as a waitress. coincidentally, this is where I met her.  The ds-260 is asking for the name. phone number, supervisors name, and address of where she worked. The problem is that this restaurant is now closed down. Hence, we do not have the phone number or supervisors name since we have no way to get in contact with them. What does everyone recommend we put in this case? Thank you once again.

List the job.  If you have pay stubs for that time you can take it to the interview.   If the form won't let you leave that field blank you can just fill it with zeros.

06/24/2017: Mailed I-130

06/27/2017: NOA1 (technically a RFE as we were missing beneficiary ID)

07/06/2017: NOA2

07/12/2017: Case assigned by Juarez embassy

07/17/2017: Packet 3 received

08/15/2017: Interview/Approval!

08/22/2017: Visa received via DHL

09/03/2017: POE

09/16/2017: Permanent Resident Card received

 

Total days from NOA1 to approval: 49

Hi! My fiance and I are in the process of the K-1, but started to think about actually living in Mexico for 2 years so he can get his masters degree (at a fraction of what it would be in the states.) So I would move down there and get married in Mexico in this possible situation.

 

-Is the Temporary Resident Visa enough to establish legal residency and then when we are ready, apply for the DCF for the CR-1? 

-Would I have to live in the states to apply for the K-3 without the DCF?

-I noticed the CA Service Center processing times for the K-3 is like 23 months...whereas the other centers are around 7-10 months. I don't know what affects which service center your file goes to, but my K-1 I-129f when to CA. The crazy difference in processing time makes me worried that it would be hard to file and know when, exactly, I would get the visa (getting it too early and having it expire before his schooling is finished, or getting it later than the 2 years, which wouldn't be the death of me but would make me pretty sad...we have plans for once we are back in the states and would hate to prolong it further.) Does anyone have any experience with this?

 

Sorry, I feel like I've researched the heck out of the K-1, and now that we have kind of switched gears, feel a little lost! Any advice/insight would be appreciated :)

To answer the specific questions asked...

  1. I'll defer to others for specifics, but I think Mexico typically accepts any physical presence of 6+ months, even as a tourist.
  2. K-3 is effectively dead. You would complete the CR-1 or IR-1 spousal visa in Mexico. For DCF, the I-130 is filed at the USCIS office abroad.
  3. See above - K-3 is dead. DCF is - by definition - when you file the form abroad, not in the US.

That said, the latest information - not yet confirmed but it is widely reported - is that they intend to close all USCIS international offices by the end of this year. That would effectively eliminate DCF. So just be aware that DCf may not be available then. You can still file for a CR-1/IR-1 in the US,...you just have to wait the same time as everybody else (~12-16 months on average now).

I did see some dates, CDJ is closing first and I forget when but in the next few months, they will all be closed by early 2020.

Thanks for the info! With the CR-1, do you know how much time from the visa being issued he would have to enter the US?

The visa is valid for up to 6 months, constrained by the medical's validity as appropriate.

 

You can delay the process at NVC for up to a year very easily., and longer if necessary. There's no issue going slower....the issue is anytime you want the process to go faster. :)

Yes the RT visa is fine as proof of residency.  I have RP and took my  Sonora driver's license and home documents also.  I have heard they will often approve on the tourist visa as well.

 

File the petition in person in CDJ if you can.  They go over everything with you sitting there.  I, the petitioner, went by myself. We got an email approving it the next business day.

 

Look at our timeline  . . . much better than going stateside.
