I-751 in process - infopass - needed or not?

Reading some conflicting information (from other sites... :) )
Background:
Wife's 2year green card expired in November 2017.
90 days prior to that expiration, we applied/submitted I-751 for 10year card.
Immediately after, got extension letter and biometrics taken care of.

(indeed, recent online "status check" reveals it has been assigned to an agent)

Average time now for I-751 is 17months.
She works - no problem there.
She has other valid ID cards (DoD Dependent card, driver's license, etc) as well as her still valid PHIL passport.
I've now read that people think an "InfoPass" is proof that their spouse remains "in status"
So -
What's the scoop?
Are we going to need anything "in hand" to show that she is legal beyond and after the 1year extension letter?

 

NOTE: EDITED TO ADD THAT WE HAVE NO INTENTIONS OF INTERNATIONAL TRAVEL DURING THIS PROCESS

Her expired card and the extension letter proves she is still legal to remain.  If after the one year and you still don't have the 10yr card then you may need to go to the local office for an I-551 stamp

Timeline

When the year is up (or close to up), if your spouse doesn't have her renewed GC, you'll get another extension letter.  You don't have anything that proves she is legal beyond that year for the extension, because there is the possibility (which may be very very remote for you) that they choose to deny her renewal if they found something untoward in her application.

Yes, assuming that your ROC is not complete by then, you make an infopass. They will stamp her passport and date it valid for one  year, and take away the greencard she has now.

Being former civil-service, this makes more sense and seems more logical. In my experience, the only time "They" leave you hanging in the wind is if there's a problem in the process somewhere.
I don't expect a problem, and our case has already been "assigned" (we chose email-alerts), so I know we are good so far.

Now, if the "agent" could put in a few successive full work-weeks, we might beat the extension letter deadline :)

Not another letter, but the I-551 stamp in passport.

No, there won't be another extension letter. As BlessedAssurance stated, she'll have to make an infopass appointment to get a stamp in her passport for work/travel purposes if her 10-year GC isn't approved by the time the letter has "expired". 

Removing Conditions Timeline

Aug. 10, '17: Mailed in I-751

Aug. 21, '17: NOA1

October 23, '18: NOA2- approval

October 30, 18: 10-year GC received

This is rubbish - you do not get a second extension letter.

That is why it you have to do the infopass I-551 stamp route if you need proof of status. If you don't need proof (for renewing a license, employer requires it, or for travel are the usual reasons why it is needed), then there is no legal requirement to get a stamp, and your status as a LPR remains.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

 I-751 Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

And, just to clear this up AGAIN, it is not when the LETTER expires.  It is from the date on the GREEN CARD.  The expiration date, and the date before which you will need an I-551 stamp is 3 years from the entry date on the green card (or one year from the date that the green card expired).

 

Even if the letter is outdated, and the green card is one year passed the expiration date, if you have filed the I-751, you are legal.  BlessedAssurance is correct in saying if you NEED an I-551, then get one.  If the employer is not hassling, the DMV is not hassling, and you are not traveling internationally, then you can just wait.

 

In my opinion, it is worth getting the I-551, as one NEVER knows when you might need to travel.
