I-130 Form Questions

Hi All,

 

I have a few questions on the I-130 / I-130A forms. Some of them may sound stupid, but better safe than sorry :) Would appreciate your responses.

 

Form I-130

 

Part 2. Information about you.

 

1.       Address History

         (12.a) My mailing address is the same as my physical address. So once I check the box for # 11 on the pdf, Physical Address 1 in the address history gets disabled. I’ve been living at the same residence for 7 years, but I can’t enter the dates for that now. So I’m trying to use Physical Address 2. Here I’m unable to type in PRESENT for the “Date To” field. Did others just print out the form and handwrite it ? Or should I be doing this another way ?

 

2.       Employment History.

         (42) I’m self-employed for the last 4 years. Should I write “Self Employed” in the “Name of Employer” field, or should I write the name of my Single Member LLC? For my citizenship application, I had written Self Employed, but here the instructions don’t seem to state a preference.

 

 

Part 4. Information about Beneficiary.

               

1.       Beneficiary’s Physical Address

         (11f) We don’t have provinces in India, but there’s no place to fill in the state. Can I fill that in the field marked for Province ? Or leave it out completely ?

 

2.       Information about Beneficiary’s family.

         (25.a) I have already listed my name in the previous section (21.a - Name of beneficiary’s spouses). I want to confirm that I need to list it again in 25.a (which asks to list the beneficiary’s spouse and children) ?

 

 

 

Form I-130A (Beneficiary)

 

1.       Information About Parent 1

·         (10.a) My spouse’s father is no more. Do I still need to input his information or should I leave that out? Her passport does have her father’s name though. And if I do need to specify his information, how / where can I specify he's no more.

 

 

Supporting documents:

 

1.       For documents to prove family relationship, what can I provide ? I do have our Court Registration certificate, pictures of the Indian ceremony (those I can print out), and we also updated our social media accounts (I could take screenshots of those ? ). Should I be providing anything else at this point ?

Answers:

  • handwrite "present"
  • "self employed" should be sufficient
  • two options, either fill in the name of the state in the province field but write the word state after the name (e.g. Karnataka State); you can also type see attached on the form itself and type the full address on a supplemental sheet
  • Yes, you will list your name again here
  • type "deceased" for information concerning your spouse's father
  • For evidence (not proof) of relationship, focus on evidence of time spent together in-person.  Updated social media accounts don't mean much of anything, if "Court Registration certificate" is the equivalent of a marriage certificate, then a photocopy of that will be required along with the forms.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Correction.  Even a deceased parent has a name, date of birth and place of birth.  What the do not have is a place of residence.  THAT is where you write "Deceased".  Provide the name.

Ryan, yes, by court registration, I did mean the marriage certificate. I'll add the photocopy, thanks.

There's no set number of pictures to send, anyone who says otherwise is mistaken.  You decide for yourself what you feel makes the most compelling case; with that being said, if you have more pictures than just the ceremony, include some of those as well.
