hi everyone

me and my husband are about to start filing for our CR-1 visa since we are newly married.

My husband is putting everything together at the moment, and he also hired a lawyer to help us.

The lawyer gave us a checklist of all the stuff he would like us to start putting together to give to him so he could file for us. (My husband took a screenshot of the checklist of what he said we needed and emailed it to me)

the checklist the lawyer gave us asked for 1 passport photo of me and my birth certificate

im a little confused, I thought I needed 2 passport photos....and do I need to sign and date on the back of the photos? (I remember for my k-1 visa a long time ago I needed 2 passport photos and was told to sign and date on the back of the photos) the lawyer didnt ask for that, he just asked for one passport photo and no signature.

and for my birth certificate can I just photocopy it and use that for the filing? My husband said to give him the actual physical copy which doesnt sound right to me at all.

Also wouldnt I need to give the lawyer stuff from my previous k-1 visa? my husband talked to a previous lawyer he never hired and that lawyer said he WOULD need all my previous k-1 visa stuff, but the lawyer he actually hired never asked us for any of that.

reason why im asking here, is because we tried asking the lawyer this a week ago and he hasnt returned our calls and I dont want to keep waiting to get everything together to start our visa.

(I told my husband we should file on our own and save money but he insisted on the lawyer..ugh )

Follow this guide that will help you a lot and save the $ on the lawyer. If your case does not have any red flags then you can do this on your own.

One question, you said you had a previous K1 visa. Was this with another US citizen?

to make it clear (because i dont know how to edit posts)

the k-1 visa was from years ago to another guy, we divorced and I had then since returned to my home country Canada and gave up my greencard.

This cr-1 visa is to a new guy I had just recently married.

Ah i was a bit too slow!

somebody correct me if I‘m wrong but I think

Yes, you need all your information...your former alien number etc!

and you also need 2 passport style pictures!

In my opinion, save your money and don‘t hire a lawyer!!! Especially because he doesn‘t seem to know much about the process and also doesn‘t reply to your questions. And you seem to be worried already and can get the informstion on here on VJ

Do I understand right, you had a K1 visa before but now you‘re married to somebody else who is filing a CR1 for you?

Or were you coming on a K1 visa and now trying to adjust status?!

I was in the USA in 2011 on a k-1 visa to a different guy I married. We ended up divorced and I moved back to Canada where im from and gave up my Greencard.

years have passed and now im recently married to a NEW guy in the USA that we are filing for the CR-1 visa while im still living in Canada.

Your birth certificate is not needed for filing an I-130.  Additionally, all USCIS requires when a petition is filed are photocopies of documents, not the actual document itself.
