What happens if your ROC and N-400 are combined and you fail the civics questions? Obviously you fail the N-400 and have to reapply but what happens to your ROC? Does it stay in limbo till you reapply for N400? Or do they still send you the card if you pass ROC but fail n400? I have looked on the USCIS site and found nothing on this. Does anyone know?

ROC is not tied to the result of the civics test. It would be adjudicated on its own. But if you fail the civics test, they would still complete the N400 interview, however you will have to do a 2nd interview for the civics part. Check part B.2)  https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume12-PartB-Chapter4.html Second interview would be within 60-90 days from the first interview.

 

If you fail the civics test the second time, then your N400 would be denied and you would have to re-apply from scratch (fees + long waiting all over again). As far as I saw from the joint ROC-N400 interviews, they don't issue the 10 yr card, eventually (whether it is after the first or second N400 interview) you go to oath ceremony with the I-551 stamp n passport, but for whatever reason if your N400 gets denied or if you decide to withdraw your N400 application, then they would have to issue you a new 10yr GC.

I don't think I've ever seen a VJer failing civics test either but according to USCIS there are some (%-wise mostly among the 65 or older group).

Yes it's part of the interview. The IO will ask up to 10 out of the 100 civics questions. The applicant has to get at least 6 right to pass. The civics test is verbal and part of the interview. I actually know this nurse who drew my blood who failed twice and had to reapply and then finally passed. This is why hubby and I got official civics test flashcards. You don't know which 10 questions they will ask.

So just 10 questions out of the 100 questions? I thought it’s like the exam that we have to do multiple choice. Thank you for answering!

That's what I initially thought too. But yep just 10 out of the 100. All verbally asked by the IO.

They will ask you upto 10 questions history/civics. You have to answer 6 correctly. If you answer first 6 correctly, they don't ask any more questions. Those 10 question are from a list of 100 questions that you need to prepare. There are many resources available to prepare. I found the booklet they gave me during the Biometrics the most useful to prepare. However, at the interview the test is NOT  multiple choice. You have to remember the answers.

Are the 10 questions predetermined prior to your interview?  That is, are the 10 civics questions chosen at random and on a print out in your file OR does the officer get to choose which 10 questions to ask?
