Good day! I don't know which forum topic should I post my query, I just put it on general discussion. I would like to ask how to change my surname of my unexpired Philippine passport after approval by court (court order on hand) regarding change of name? Will the Philippine consulate honor the court order given by the court here in US? Or is it okay to have my Philippine passport's name different form my green card (currently processing change of name on my green card)? Would there be any problem when using my passport under my prior name and green card under my current name when I travel to PHIL-USA back and forth?? Thanks...

I would recommend you calling the Philippine embassy with regard to your last name change.  For traveling though,  you might need an affidavit showing than you are the same person on your gc and passport.

You have not completed a name change within the Philippine government?   Doubt they will give consideration to a court order from a foreign government (USA).

 

It is fine to have your name being different on your GC and passport, do carry a copy of the court order with you when traveling outside the USA.

 

You would have to contact the Philippine consulate on how to change the name on your passport (I bet they will tell you to complete the name change process through the Philippines court)

There is plenty of information on the Embassy website.  My understanding is it is a fairly easy process to change the passport as long as you have the proper paperwork.  However, you will need to make a physical appearance in order to do so.

11/14/17 129F mailed

11/17/17 NOA1

05/14/18 NOA2

06/06/18 NVC received and case # assigned

06/12/18 left NVC

06/13/18 Manila Embassy received

06/13/18 CFO completed at Clark Pampanga

06/18-19/18 Medical exam

07/10/18 Interview - APPROVED!!

07/29/18 POE

Hindi po. You do not need to make a physical appearance in order to do this. The first thing they need to do is file a Report Of Marriag(ROM) with the Consulate where they got married. Once that is complete then they need to file for a passport in their new name.

My understanding is that in recent years they have changed the rules.  Changing the name would basically be a passport renewal.  This is directly from the Consulate website: 

 

The Embassy/Consulate General advises all Philippine passport holders, whose passports are expiring within the next 6 months, to renew their passports if they intend to travel within the aforementioned period.

All Filipino citizens applying for passports with the Philippine Embassy/Consulate General will no longer need to submit photographs, as their picture, together with their fingerprints and signature, will be taken on-site. This means that all passport applicants, regardless of age, are henceforth required to appear personally.

Dummy me I didn't look to see the visa category. He came in on a IR-1 so he already had a CEMAR listed. I thought he came in on a K-1 thus the need for a ROM if that was the case.

This person was an IR-2 visa, that did a court process here in the USA to change their name legally and was asking if that would be accepted by the Philippines (which I doubt it would) to have their passport renewed in this name.

Sadly, I doubt the Philippines would recognize the name change completed in the USA.  

They might have changed the name to the new married name. But alas the op has not been back so who knows.

Read his post ... marriage was NOT mentioned and one doesn't need a court process to change their name when married.   And to A$$-u-me is never a good thing.  ;)
