Naive mistake: should I withdraw K1 application?

If I were you, I would consult it with an immigration lawyer before you decide to withdraw your petition. They will give you an advice on what to do or how big of a problem it could be. Or wait to see if you get approved by USCIS. If you do, then you can explain everything at the embassy during your interview. But I think consulting a lawyer would be the best thing to do in this case.

Btw. I made even worse mistake - in my letter to the USCIS about our love story I mentioned that we will have a wedding in my home country (we applied for k1 visa), because at the time when we filed the petition I didn't know you couldn't have a wedding in your home country first, I just thought you then have to have another wedding in the US :) I just didn't do a good research on the visa first :) And our K1 was approved! We didn't get any letter from the USCIS mentioning this mistake, nor was it ever mentioned at the interview at the embassy. The interview was super easy and like 2 minutes long :)

thanks for looping me in @vocaledge

Hi @Unidentified and @geowrian

We applied April 11th 2017, and received a NOID in early December BEFORE NOA2 (I've forgotten the date, but it's in my signature) because we missed one tick box, and didn't submit evidence - we had a mix up with the paperwork and were under the impression that they would ask for the evidence forms and additional evidence at a later date. We got this filled out and returned ASAP, and very shortly after receipt (appx 2 weeks) got our paperwork approved.

If you need any more help let me know, I don't know how helpful I can be :jest:

  • 04/11/2017 - I-129F Received - NOA1

  • 02/01/2018 - Left NVC

By the way, shout out—I’m from New Bedford.  I really wish I could move back to Massachusetts!  My older kids are in North Andover.  I want to have my wedding dinner at the Lebanese place in Norwood since my kids, ex and fiancé are all Middle Eastern.  My fiancé is so nice to let me have Arabic food just as he left that behind, lol.  We can go for lobster too.  Just not the same day!  I really think you will be fine. Not even an RFE.  But, the CR-1 does give a green card upon arrival.  Weigh your options carefully!  ❤️

Hahaha. I am actually from Massachusetts as well (Cape Cod)

We got married in Massachusetts last summer (we don't live there anymore but all my family and friends are still there).

If you make it past the K1 for approval don't make the wedding license mistake my husband and I made in Massachusetts (each state has different laws). We didn't realize you had to get the marriage license, together, at least 48 hours before the wedding meaning Monday-Friday (I thought Saturday counted as part of the 24 hours).

So we spent the Thursday before our wedding expediting our marriage license by and driving between the court house and local town halls which cost a couple hundred extra dollars. Haha. Lesson learned (the hard way) but it all went smoothly after that!
