Hey guys, me (British) and my American fiance currently live in London and she is moving permanently to New York in July. We are trying to get together my k1 visa application in advance so that I can join her over there asap. 

 

I apologise for how noob my questions may be but they are as follows: 1) for her 'mailing adress' on the i-129F form, do we put her current London address? She doesn't yet have a New York address..Furthermore the form asks for 'address in US where your beneficiary (me) intends to live. Again, this is hitherto unknown.  2) are there any special forms/procedures for Americans living abroad, and finally 3) where do we submit our application? Does she post it from here to the US embassy in NY?

If you are only just beginning the process now, you won’t be moving until around Christmas time. That’s roughly how long a K-1 is taking now. 

 

If your fiancee lives in the UK, why are you even considering a fiance visa? Get married and file a spousal visa through the London embassy. Takes around 4 months so would fit in perfectly with your timescale. With a spousal visa you are a permanent resident immediately upon arrival and can work right away. The K-1 is basically an overpriced tourist visa that lets you stay beyond your 90-day visit if you get married during that time and then pay over $1000 more in fees to adjust status. You cannot work for many months. Nor can you leave the country for many months - not even a quick trip back to Blighty or a nice honeymoon somewhere overseas. 

 

The K-1 is the worse choice for people already living together overseas.

I completely agree with @JFH, go back and re-evaluate your options as I believe you will find filing for a spousal visa a better option.

I agree with the above two posters -- if you're eligible for DCF, it's the way to go here! If not....

 

1) You can either put her current London address or a friend or family member's address (there is a spot on the form for care of). I put my foreign address at time of filing, but now that I've gone three weeks with no physical NOA1, I will likely change it to my sister's US address so that mailings get delivered more quickly. I also used my sister's address and phone number for intended address. We probably will not be staying with her for any period of time, instead renting our own place once I move back stateside, but it is an option. 

 

2) Not really, other than the alternative of DCF for a spousal visa as mentioned above. For K1, just be aware of the financial sponsorship requirements, and that foreign-earned income will likely not count towards the minimum income requirements for the US citizen. (I'll be using a joint sponsor for this reason, even though I earn well above the minimum.) This will likely not be a problem for you, though, as, AFAIK, London allows self-sponsorship. 

 

3) All K1 applications get posted to the Texas lockbox, not to any embassy/consulate. You can use UPS/FedEx/DHL to mail from abroad.

Thank you guys, super helpful. 

 

Our issue is that the reason she is moving to the US is that her work visa here has been revoked.  For her this means leaving the UK in order to apply for a marriage visitors visa to then get married, which is not an option given work commitments etc. 

 

Perhaps the best option is for her to move to the US and then apply for a UK marriage visitors visa, then come back for the wedding and go through the US spousal visa process.
