Hi,

So I had my interview at the embassy on Tuesday and everything seemed to go well as I answered all the question thrown at me. However I was handed a blue form where the officer stated that I need to provide additional documents such as proof of home ownership & affidavit of support from my co-sponsor. They kept my passport & told me to email the documents. I'm just wondering what this means? I didn't receive an indication of any approval. How long will this process take? I'm kind of panicking

It means that you have to provide listed documents and then they will make final decision. I assume this is AP, so its going to take as long as needed.

09.2015 - Green Card received.

I'm surprised you attended the interview with no affadavit of support.....  Anyway - provide what they asked for and you 'should' be fine.

You must present I-134 and whatever financial documentation the co-sponsor will be using as evidence along with the form. An employer letter is usually favored by London. So is a tax transcript.

This form and supporting evidence is a critical piece of paperwork you needed to bring to the interview. Is there a reason you omitted it?

I did bring along the affidavit of support. However I was unaware that another one was needed from my fiancée whom is not the main sponsor. I guess I'll just have to sit tight. Thank you!

I did bring along the affidavit of support. However I was unaware that another one was needed from my fiancée whom is not the main sponsor. I also provided the letter of employment & the tax. We thought we just needed to rely on her father as my main sponsor, but they also wanted information/affidavit of support from her.

AP? As in 'Administrative processing' then yes that's the current status. Is there a way of finding out how long it will take?

Typically, how it works in London is that when using a cosponsor, you only need to bring the documentation of the cosponsor. There is no official rule change that I know of regarding this - so it is possible that you had a newbie CO or something else that we're not aware of.

 

At any rate you must email them what they requested from you. Once they have this, it is likely you will be approved. It may take some time. You'll remain in AP until they have what they asked for and are done processing the case.

This part sounds like the sponsor listed a home as an asset with nothing to show ownership, appraised value, or what if anything is still owed on it. Otherwise there's no reason to have to own a home in order to be a sponsor.

 

Can you copy the exact wording written on the 221(g) or take a photo of that portion.

Yes you're absolutel right about the home listed as an asset! Didn't present the documents to prove its worth. Thank you

Yes, we have sent all that was requested. We'll just have to be patient and hopeful.

So if a home is listed in the assets section, they need proof of value and out standing mortgage amount?

Well first off, listing a home as an asset is kind of a last ditch effort. So are you going to sell the house and be homeless to support the immigrant. If there is enough salary, skip the assets completely.

 

BUT if you list a home...say $300,000 house.

First it needs verifying with an appraisal and not your word saying it's worth.

Secondly if you owe $250,000 on the mortgage, then your asset is only worth $50,000. So if you want an asset to count, be able to document it's worth from something other than what you dream up in your head. 

 

The I-864 affidavit of support gives much more detailed instruction and provides a good guide to use for assets:

 

Only assets that can be converted into cash within one year and without considerable hardship or nancial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owner’s claim of its net cash value. 

 

You may include the net value of your home as an asset. The net value of the home is the appraised value of the home, minus the sum of any and all loans secured by a mortgage, trust deed, or other lien on the home. If you wish to include the net value of your home, then you must include documentation demonstrating that you own it, a recent appraisal by a licensed appraiser, and evidence of the amount of any and all loans secured by a mortgage, trust deed, or other lien on the home. You may not include the net value of an automobile unless you show that you have more than one automobile, and at least one automobile is not included as an asset.

i am using my fiancé, but he works for him self (Uber) and I do t really understand the whole tax stuff! However he meets the criteria. 

We have used his mum as back up, but she put details of her home on the form. It has been posted yet, but I will get her to remove this, and just use her salary.
