Hello all,

I want to see if i can mail in my wife and daughter's petition tomorrow,

Just a quick question before i send it.

If i file for my wife, is it required that i file for my 1.5 year old daughter or will the same application cover both of them.

i.e my daughter as derivative.

Got LPR status through family in Feb 2017
travelled back to Nigeria in Aug 2017, got married
file i130 for wife and daughter in January 2018
Case transferred from CSC to NSC in July 2019
got RFE in Oct 2019.

Both can be on the same application if she is biologically your daughter.

 

She must be added in your wife's i130 as derivative.

March 14, 2018: NOA1  / E-Notification // Physical Mail: March 20, 2018

March 17, 2018: Biometric Appt Notice received //  Appointment: April 6th

March 29 RFIE // April 11 USCIS received RFIE response

May 10, 2018: I-130 Approved  :D *But case sent to NVC*

July 11: INFOPASS Appt + Sent Additional Documents

July 20: Case Ready for Interview (Finally!)

August 14: Card being produced //  August 22: Combo Card in hand

yes, my wife is her biological mother, i am the biological father..

if i get you correctly, I will only mail in $535 not $1070

yes if you are a resident

 

If you are a US Citizen, then you will file both cases separately, there aren't any derivatives for immediate relatives of a USC

 

if you are a legal permanent resident, then yes. your stepdaughter will be the derivative of your wife and you will file only 1 i130 if she is under 21

Yes i am a permanent resident.

also does i-130A form apply to me?

I got the form I-797C Notice of action today saying her priority date is January 31, 2018

the beginning of a long wait.

Now is the time i need a C on Monday's bulletin just like August 2013.
