Hello all,

 

So I've done alot of reading on these forums, but had some questions about the CR1 process. I live in the U.S, and my spouse lives in the Dominican Republic along with her son (who I'm also filing for a visa for), and our unborn little one (she's only 3 weeks, but we're hoping to have the baby born here in the states). My wife, and I are both 25 years old.

 

1. Our marriage certificate is in Spanish. I've read online it just needs to be translated, not apostilled, and the person needs to certify they speak Spanish/English. Can I really get anyone who isn't my wife or I to translate it? I don't mind using a certified translator, but we're looking to save on money...and I was curious if anyone had personal experience here.

 

2. We have numerous photos together spanning for almost a year in all types of locations, I have receipts for flights over there, our engagement ring, etc. Will numerous pictures, receipts, Facebook/Whatsapp messages be adequate at the petition phase? Will descriptions of these images be sufficient, or should we strongly consider also including a couple affidavit of supports?

 

3. I've read that after the petition is sent to NVC, a packet and documents are sent out. Are these all sent to the requester, or will the packet be sent to the beneficiary (my wife)? She lives in a location where mail isn't delivered, so I'm hoping it gets sent to me so I could have it held at a Fedex location.

 

4. I'm still confused about what all the NVC phase entails, are they asking for new documents or the same types of evidence I originally submitted in the petition? Is the NVC phase mostly driven by the beneficiary supplying evidence at this stage? I just want to try to figure out what my role is.

 

5. For Latin American names, I'm confused how to properly list it on the petition form:

Anna (First) Maria (middle) Garcia (paternal) Rios (maternal), would I simply list the paternal under family given name and omit the maternal?

1. Anyone can do the translations, as long as you include a letter saying that "I, (insert name) am fluent in both English and Spanish and certify this to be a true translation of document (insert document name).  - then sign, date, and put your address. (or the information of whoever did the translation)

 

2. I'd add any kind of proof of bona fide you can get your hands on. I don't think you can have too many different proofs.  I included a pack of 15 years worth of photos, a car title with both names, travel records, proof of my previous Peruvian residency, money transfers to my husband from me, and 3 affidavits from friends/family.

 

3. Someone further along in the process will need to answer this one :)

5. I used both the paternal and maternal surnames as my husband's last name on all documents.

Original DCF: June 2015

Original Approval: October 2015

File closed for inactivity: December 2017

:Ans: This is the exact quote from state website for Dominican republic "Dominican civil documents used for visa purposes must be legalized at the Oficina Central del Estado Civil, the main civil registry office in Santo Domingo." As previous member mentioned, you can try that or find a professional service who can provide  translation for low cost

 Ans:

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:
1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financial resources; or
4. Birth certificate(s) of children born to you, the petitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or
6. Any other relevant documentation to establish that there is an ongoing marital union.

Ans: You will be the primary corresponded as Petitioner. I would recommend you to  file G-1145 form along with I-130 and I-130A, then you will get everything via email, you don't have to worry about any mail.

Ans: Please read I-130 instruction before you fill out I-130 forms. You should answers everything that you need to know

Fwiw the g-1145 only provides and email when the petitions are accepted.  You need to sign up on the USCIS website to recieve any futher emails.  Also the NVC will request emails if they dont already have them.

The text I placed in bold and green is good because it shows evidence of time spent together in-person.  This is your strongest type of evidence so that should be your main focus.

 

The text I placed in bold and red are worthless pieces, engagement ring means nothing and the affidavits you speak of carry little to zero weight in the overall evaluation of a file and they are not required.
