he might be fine, he might not be, if they pull the old file they will see the old pictures, and the picture has to have been taken with in the last year. if you can it would be best to get him a new one just to be safe, however he can try with the old one the least would happen is a RFE to get new ones.

The I-130 instructions say that the passport photos must be no more than 30 days old. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Timeline

(3) You must submit two identical color passport-style photographs of yourself and your spouse (if he or she is 
in the United States) taken within 30 days of filing this petition. The photos must have a white to off-white 
background, be printed on thin paper with a glossy finish, and be unmounted and unretouched.
The two identical color passport-style photos must be 2 by 2 inches. The photos must be in color with full 
face, frontal view on a white to off-white background. Head height should measure 1 to 1 3/8 inches from top 
of hair to bottom of chin, and eye height is between 1 1/8 to 1 3/8 inches from bottom of photo. Your head 
must be bare unless you are wearing headwear as required by a religious denomination of which you are a 
member. Using a pencil or felt pen, lightly print your name and A-Number (if any) on the back of the photo.

 

You can take a photo, send the file by e-mail and your wife / husband, print it at some photo shop.

I believe you need a phone that is took with 6 months. But I'm not sure. But for sure. Do not try to used the one which you have used for the first application.
