Form I-130 question

Hi Guys,

 

Really sorry if this has been asked but I'm confused about a question on the I-130 form. I live in the UK and want to get a CR-1to live with my wife and we are stuck on this question:

 

The beneficiary will not apply for adjustment of status in the United States, but he or she will apply for an immigrant visa abroad at the U.S. Embassy or U.S. Consulate in:

 

I was under the impression that it was my wife applying for me to obtain the CR-1? Does this mean we send our package and forms to london or to the chicago office?

 

Another quick one: Should I send original documents in the evidence section i.e. original marriage certificate as we plan on including wedding cards we got as part of evidence, would pictures of them do?

Your wife is a US citizen and she lives in the states?

She needs to send I-130 petition with all required documents in the states, whatever address they specify for that purpose not to the US embassy in London. You will have your interview in London.

for the question from the form that i posted, do i fill that out with the london details or just put N/A?

I don't quite understand what you mean. She needs to fill out her and your information and send it. Where it asks about address she needs to write her current address in the states  and your  current address in London if it is what you meant

is this relevant to my case or should I leave blank/ put N/A. Sorry for the confusion!

yes, she needs to put the embassy in UK

 

you have to answer one side or the other where you will have your interview. you will go through consular processing at the US .Embassy in your country.

You won't need to apply for adjustment of status. This is for those people who travel to the states on a different  visa and then had to adjust their status to the immigrant one. So this is yes, to that statement that you wrote. You won't apply for AOS but you will apply for an immigrant visa at the us embassy in London. Petition i-130 is not a visa yet. The visa process will start after the petition gets approved. I hope I explained it clearly

Don't send originals, you will not received them back.  Send photocopies as those will be accepted, pictures of items such as your marriage certificate are not acceptable.

Adjustment of status only applies to you if you are in the USA on a visa, either working or going to school, or something like that.

 

You are to fill out the i-130 package and send it to US office designated for your wife's area. 

 

Don't send original certificates or licenses, only copies!

Just a note that the question about originals or copies indicates the OP has not yet become an A-student of the I-130 instructions.  Doing so will be critical to the ultimate success.
