My wife's case is still at NVC, that's probably why she hasn't received the EAD+AP so far. Do you think we can actually go that route yet?

I just called NVC and we can go back that route. I have to inform USCIS that we won't move forward with AOS and they may refund the fees. That's what NVC agent says, very friendly.

You can ask him. Any update on your case? Was it assigned to an officer?

No news! ahahahahaha

Last time I called they said that it was under review and to keep waiting.

Last night I started preparing all documentation to send to the Ombudsman service..
I'll try to call them maybe tomorrow...

Did you confirm with NVC?

I am taking the NVC route. Yesterday I paid the fees and the process would take less time by doing it with them. I am wondering how I inform USCIS that I won't move forward with the AOS.

Would you have received your green card if have had gone through CP? I would ask also everyone in this thread that CP or AOS if had a second chance? Some ones may need maintain legal status through the authorized stay by AOS, but for those who are inside the states already with valid non immigrant visas and will still be valid when PD becomes current, was CP not an option at all when applying for AOS
