Hi, Everyone, 

 

I have a couple questions that I am hoping you guys can help with. 

My partner Adam, will be aiming to start our I-129K application as soon as possible (beginning of the new year) 

i have two sons home here in the uk with me ages 16 and 19. 

 

My questions are:

if we do not have a decision by the time my eldest son turns 21 (in May 2019) will it be taken into consideration that we have applied for a  Fiance Visa before he was 21? Or will they refuse my son because he has turned 21?

 

also, will the fees for our I-129K be the same or will more fees be added onto that because we are adding my children? Will we have to pay separate fees at all during this process?

You talking about I-129F, right?..

 

No additional fee for  kids, filing I-129F. They have to be listed in the petition regardless they will be immigrating with you or not.

But each of you have to  have your own DS-160 application and pay visa fee. So, it would be $160 times 3. The same with medical exam - fee x3. But all of this comes to play at the Embassy stage, after I-129 F approval.

 

As for your oldest son... He needs to enter the US before he turns 21. If he has his K2 interview after he is 21, his K2 visa will get denied. Time of I-129 filing won't be taken into consideration. 

Currently, it takes 5-7 months to process I-129. When 2-3 months from NVC to the US  Embassy in your country. If you submit your I-129F in January 2018, you should be fine. Nothing is guarantee, of course, but there is a big chance to enter US before May 2019.

You will also need written permission from the father of the younger child to be allowed to remove him permanently from the U.K. Does he have a father listed on his birth certificate? 

 

The other "child" is over 18 so no permission needed for him.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

No, the father and I never married. I’ve just looked online and found out that if my child was born before 2003 and the father is named on the birth certificate here in the uk but we was not ever married then that means he has no parental rights. 

 

So so I can assume that if that’s the case than that means I won’t need his father’s permission right? I mean I was able to change my sons last name by deed poll and didn’t need the father’s permission for that because of the year my son was born it meant father’s didn’t have Patental rights unless married?

I'll just add/correct 2 items:

  1. The K-1/K-2 MRV fees are $265, not $160. $160 is for a tourist visa (and some others, I think).
  2. Each child will need to go through AOS once in the US. This can get quite expensive very quickly, so be sure to budget for it ahead of time!
    1. I-485 (AOS) Fees:
      1. Wife: $1140
      2. Child filed at same time as wife: $750
      3. Child filed separately from wife: $1140
    2. Biometrics: $85 (ages 14-78)

You are right , my bad.. $160.00 is B1/B2 visa fee, not a K1/K2. Thank you for correction :)
