Hi everyone. I made a new thread to everyone who can answer my queries.

my husband is filling i-130 and i-130a for our little one since crba was been denied due to my husband's lack of physical presence. What other items/documents shall be included in the packet. My husband's planning to send it by next week. I am kinda confuse about the i-130 and i-130a form? Are they separate forms? I-130 form costs $535, so my husband need to pay $1070 since he will be petioning the both of us. Its really hard to get and consult an attorney because my husband will cost alot. So i made a thread for us to follow. Please help me through out our journey. God bless everyone.

Two I-130s, one for you, one for the child.   One I-130a this is for you.   Yes filing fee is currently $535 for each I-130 as your husband is a USC.  

 

It is not difficult to complete the I-130 (& I-130a), do follow the instructions sheet from the USCIS website, include all required documents as listed.   And come back here with any questions.   https://www.uscis.gov/i-130

 

Also the process for you and your child is listed here:  https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/petition.html

  • Certified copy of marriage certificate (this would be PSA)
  • USC, proof of citizenship, this is your birth certificate, or, ALL pages of your passport (yes including the blank pages)
  • Previously married (petitioner & beneficiary); you will need to include copies of your annulment, divorce decree or death certificate
  • 2X2 passport style photos, with name printed on the back (both petitioner & beneficiary) Use a baggy to attach them.
  • Evidence of bonafide marriage;  examples are listed in the I-130 Instructions Sheet

If you are the beneficiary, why are you completing the I-130? This is for the petitioner to complete. It's not difficult. All it is is a list of questions about the petitioner. It's not a paper in advanced calculus. He should have no difficulty with it.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Yes.  complete an I-130 for you and then one for the child.  The I-130a is for you, but your husband is allowed to complete it for you (per USCIS instructions)

Will he filled it out again and place our names because it is so obvious that i am the mother and he is the father because he is petitioning the both of us

It might be obvious to you but you still fill it in.

 

FWIW, he could be the step father (versus the biological father) and still petition for the little one.

Complete each I-130 with the required information, doesn't what seems obvious, for your child's I-130 if it asks for parent's name list your names.

Thank you. Which is better to use while filling out the form? Using the black pen or will he just fill it out on the computer/laptop?

CRBA is not petitioning another beneficiary.    CRBA = Consulate Report of Birth Aboard.

 

Did your husband every petition another person to get an immigrant visa?   That is the question
