Need help!! Got RFE after 15 month (divorce waiver)

Dear VJers, so i just received mail from uscis shows that i got RFE (literally after 15 months waiting)

i am a july 2016 fillers (divorce waiver) but on RFE says that i was filed jointly with my (ex) wife so thats why they asked me for more evidance. Also they send me back the page 3 of i-751 form and circled the part 4. My questions is:

 

1. Does my RFE means i just need to fill the part 4 and send it back to them?

2. I’ve sent tons of evidance while i filed them last year including my divorce decree and pictures from our wedding, is that ok if i re-send the same evidance? which is thats all i had.

3. Should i write a letter and make them clear that i was filed as a “waiver” not “joint petition” ?

4. How long does it normally takes for them to make a new decisions after i send the RFE?

 

i would much appreciate for any help/answer. Gbu.

You have to specify your spouse information on part 4 on the form even you're failing for waiver since you got your conditional green card status from your spouse.

 

1. Does my RFE means i just need to fill the part 4 and send it back to them? - Yes

2. I’ve sent tons of evidance while i filed them last year including my divorce decree and pictures from our wedding, is that ok if i re-send the same evidance? which is thats all i had. - send them back and if you have additional then include them as well.

4. How long does it normally takes for them to make a new decisions after i send the RFE? - Not sure but as far as I know it may take a while given the processing time of CSC

I submitted copy of my conditional gc, copy of marriage certificate, copy of auto insurance, copy of apartment lease agreement, copy of letter from the bank that me and my ex wife applied for joint account. Since i separate from my ex wife for a year before we got divorce, i am pretty sure that she already threw away all the mail that has been sent to our old address.

Thank you for your answer. Anyway should i return the original of page 3 that they made a circle of it or should i make a copy and send them the copy?

to be honest i dont have much evidence left. What if they not satisfied with that? Will they denied my ROC and deport me? Or is there any other action i can take?

Should be formal words since you're dealing with US government and seeking approval of your I-751.

Gotcha! I was thinking to “beg” them with my casual words but yeah you right im dealing with US government. Anyway on those page 3 form should i send them the original which has red circle marked or make a copy and send them?

just use the original form with circle that they sent to you and send it back to them with your letter and evidences. Just make a copy on the said 3 pages for your own record. 

 

Just to be on the safe side. Always make a copy of all the forms, letter and evidences that you submitted to USCIS, this way, you can have a back up in case they lost your files.

Unfortunately i sent them my original certified divorce decree last year. Hopefully they will send me back :(

When you are writing your cover letter, refer to their letter to you and include copies (even if you've already sent them) of all the items you have, and explanations of anything you don't have.

For example, with reference to your letter, if it were me:

  • I have included copies of my driver's license and my spouse's (for you, if you have your ex's d.l. copy, I would write "ex-spouse's)
  • I have no children, so I have no birth certificates to include. (etc)

Refer to each point on the list they enclosed, either confirming what you are sending, or explaining why you don't have it to send.

You will have to apply for another copy of your divorce decree - see if they will rush it to you... USCIS almost never returns anything, which is why you never send originals unless they specifically request them. What's done is done, so you'll have to get another one, and include a copy of it with your RFE response.

 

Also, try not to be too worried that you're only getting an RFE now, after so long... RFEs happen when someone actually touches your file, and this is the first time someone has touched it since they sent the confirmation that they received it.

Too bad i dont hv copy of her DL, all documents from AOS is in my old address and im sure she already threw away :(

for the cover letter, can i do writing hand letter?
