Son's employer won't let him have the day off.....

Timeline

My son has now been placed in Removal Proceedings and we are headed to Court, after almost 5 years of trying to reason with the USCIS.

Later this week we have an appointment with our congressional representative to discuss what she could do to help - although I doubt she will do anything, she hasn't so far. My son asks his boss if he can have the day off to attend this meeting - his boss says "No". My son tries to explain that it is to try and gain some congressional help with regard to his immigration situation. His boss' reply "I've given my answer and it remains the same........No!"

This has got to be the meanest boss I have ever come across - he would allow my son to be deported rather than give him a day off work to fight his corner!

I told my son not to worry, we would make his case for him and when he has to attend Court he won't be asking his employer for the day off..............he'll be telling him!

I couldn't believe it when I heard - my son has worked extra hours, into the night, to help these guys out of a mess, in the past. I guess he won't be doing that again.

Also, if he is in removal proceedings, can't he take time off to get a job after the verdict happens?

Good luck with the Congresswoman. I hope she can do something to get this all sorted out for you. I can't imagine how draining this all must be for your whole family.

I complain because things always take so long for us in processing both my daughter's and my own cases (we have to file everything separately because she followed-to-join and can't be included on any of my applications). But, we haven't had to go through anything like you have had to endure.

Keep us posted as to what happens after your meeting with the Congresswoman.

Hopefully, this will all be over sometime soon.

I don't think pretending he is sick is going to wash! I guess we may all have to take "time off" when the verdict comes, as we may all be looking for work outside the US.

Ugh! Girona it is one stumbling block after another, isn't it!!! It's awful that an employer won't cooperate with something so important.

Have you had your son sign the form that will allow the representative to inquire about his case? If you haven't, you might want to call and have one faxed to you, if possible, so that your son can at least sign it and you can have it at the appointment. David and Chris had to sign these forms in order for our representative to assist us with their AOS inquiries.

Would a curt letter from your lawyer scare him into it? Perhaps even a letter from the Congress person he has a meeting with? That way his employer would know that their behaviour towards your son is being noticed...

What job? Is it a big fortune 500 company or is it one of those mom and pop stores? If it's one of the fortune 500, he can follow the chain of command. In other words, if he is unable to get an approval for a day off due to an important reason from his immediate supervisor, he may go above his immediate supervisor to get the approval. However, if he's working for a good old mom and pop store, he is after all employed based on will of the employer.

A court date is important. It should not be disregarded. The employer should be well aware.

He has always kept his employer well aware of what is going on with his immigration status. In fact, my son has been totally honest when it comes to anything to do with immigration, with his boss and with the USCIS, but it still seems they all have it in for him!

The company he works for is not a small company, but the problem is that he deals with his immediate supervisor on a daily basis and he can make my son's life very difficult if he goes above his head. I told my son not to worry about this appointment on Friday, that both myself and my husband will make sure his voice is heard. Oh, and he signed the necessary papers years ago to allow us to receive information on his case. Unfortunately, the congresswoman for our state has done nothing to help and this is the first actual face-to-face meeting we have been granted, so it's a pretty big deal.

When it comes to hearing dates, there is no way my son will even ask if he can have time off, he will be telling his boss that he is taking time off. If they don't like it there really isn't much my son can do, he has to appear and that's all there is to it. I guess if they fire him there isn't much he can do about that.

It is just so unfair that he has been through so much and it just continues.

Not that you want any more legal dealings, but I'm sure there's a legal aid in your area that could answer that question for you.....it certainly sounds illegal to not allow time off for court.

Are you friends with a doctor. They would not be able to disregard a doctor's letter detailing sick leave, would they?
