Hi all,

 

First time poster, long-time lurker. This site has been really helpful while my wife and I waited approval of our I-130's for the CR-1 Spouse Visa.

 

Two weeks ago, we received two of our three NOA2's - for my wife and one of my stepsons. I had a hope that there was just some paperwork mix-up and all three were approved, but they forgot to send the third notice.

 

After a week, our case status was updated on the USCIS website. Only two cases were updated. I called USCIS and created a ticket for them to look into it. I still had a hope that all three files were sent to NVC but they just forgot to enter one of the numbers in the computer.

 

Today I called NVC and they confirmed that the two were received. The third was not.

 

This is very upsetting, because I fear that the third has somehow become lost. All three were part of the same package, received an NOA1 on the same day, and the primary I-130 form showed that the other two cases were related.

 

A few questions:

1) Is it possible to continue with my wife's visa as quickly as possible, so that at least she can come and visit for a while? Right now I'm flying to Russia every month for a week, except for occasionally she will fly to Canada when she can find someone to watch the boys. It's exhausting and very expensive.

2) Are there any other avenues for resolving issues with the 3rd case besides waiting up to 30 days to hear back on the ticket I created?

3) Once the issues with the 3rd case are resolved, can i somehow expedite it through the NVC process to catch up with the rest of them?

 

My wife and are feeling very demoralized. We waited 9 months for our NOA2, and now some of the paperwork might be lost....

 

Dates

NOA1: Jan 23rd 2017

NOA2: October 20th 2017

USCIS Website Updated: October 27th 2017

NVC Received: October 31st 2017

because if the 3rd file isnt there they wont interview together.  Depending on how long it takes for the file to be approved and go the through the nvc process, one child could be left behind.  Which Im 99% sure your wife would not be happy.

Alternatively, they can do as the OP mentioned, which is to proceed with the wife's visa only, and wait until both children's files are at NVC to proceed with the children.  If leaving both children behind for a while works for them, it works for them.
