Hey all,

 

I'll make this quick.

My wife and I filed my i130 alongside my AOS and my i765 back in July. We had an RFE requesting initial evidence for her income in August which we sent off in September. We are yet to hear from them. 

 

My wife can no longer work in her current role as it is mentally and physically draining her. She feels she cannot continue this role as it does more harm than good.

 

She is quitting her job and is hoping to find one asap. (She typically has no issues finding new employment)

 

My question is - Will this effect our case?

I spoke to a uscis advisor prior to this decision and he had stated that the uscis would never ask someone to 'put their life on hold' in terms of employment for immigrstion purposes and looking to better themselves. He just stated that when it comes time for the interview, we should alert them and provide evidence for her job change and proof of income. 

 

Would 1-2 weeks of unemployment effect our case in anyway? She currently earns above the 125% and her new role will also be above the 125%.

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

no it will not

I don't think it would affect your case.

Just do what the person from USCIS told you - be prepared to show proof of employment at the interview.

10/30/2017 Package delivered 

10/31/2017 Priority Date

11/07/2017 Received email and text notifications about all 4 forms

11/14/2017 Received hard copies of all 4 NOAs

11/21/2017 Received biometrics appointment notice scheduled for 11/29

12/15/2017 Interview notice - interview is scheduled for January 19th! Holy #$%^ that's less than 3 months from PD!

01/02/2018 EAD + AP approved

01/16/2018 Combo card delivered

01/19/2018 Interview - recommended for approval

01/22/2018 New card is being produced :dance:
