Good afternoon, my wife and I had two questions about various reports abroad. First, for the report of marriage, I had to print the form at 80% size so that a notary could fit the stamp on the form. Will this cause any problems for the consulate? And secondly we are having a baby girl in December and on the report of birth it indicates that the middle name MUST be the mothers maiden name, however we would prefer the middle name be named after my mother. If we fill out the report of birth with that middle name instead of the maiden name, will it be bounced back or will they still accept it? Thanks in advance.

If this is for the Philippines, yes, the middle name must be mother's maiden name. You can just have a second name (your mother's name) added to your baby's first name.

 

Example: Mary Elizabeth_Cruz_Smith

 

Example above is First name & Mother's Name_Middle name_Last Name. This is what will be reflected in papers originating from the Philippines (and any forms for the Philippines). But once the baby will be in the US, you can use "Elizabeth" as her middle name and will not really cause a problem in the U.S and "Cruz" will be totally removed/unused form all forms of identification. I don't know why either.

 

The concept of middle name is different in the Philippines vs US. Middle names are ALWAYS the mother's maiden name. :) The country follow the Spanish system for naming where mother's maiden name is always reflected in the name.

Sadly it will be hard for you to get a reliable answer. Protocol, procedure, and consistency or not familiar words to Philippines government  :D what might be the case for one consulate may not be the case for another. It could even vary from who you talk to at the same consulate. I would think that as long as you have the notarized stamp that would be most important.

 

As for the name there have been stories on here where people have named their children without following the customary structure of naming in the Philippines and people have even argued that there is no law saying you have to while others say there is. The people that go against it will always have to be prepared to battle with any legal documents in the Philippines so I think the suggestion above is best. To me it just wouldn't be worth the fight.

If you are in the Philippines then yes you might have to name the baby after the mother maiden name. But if you are living in the USA then name her however you want to name her. I have two daughters that we did a civil registry for here in Los Angeles and they had no problem with the middle name. We names them however we wanted.

Here is the official wording for Filipino name convection as promulgated through REPUBLIC ACT NO. 386 "AN ACT TO ORDAIN AND INSTITUTE THE CIVIL CODE OF THE PHILIPPINES"; ARTICLE 370. A married woman may use:

 

(1) Her maiden first name and surname and add her husband’s surname, or

(2) Her maiden first name and her husband’s surname, or

(3) Her husband’s full name, but prefixing a word indicating that she is his wife, such as “Mrs.”

We did ROM at a consulate outreach event, the form was printed full size and the embassy notary stamped on top of the form where it was signed.  Not sure how they will react to a "mini" form.

 

Many have completed ROB using the American naming process, I doubt you will have an issue.

Well, I shall let you know what they say. Luckily it is barely any smaller, but with my wife at 7 months, we don't wanna go through all the stress of flying from Texas to California. If they bounce the form back I'll print on legal sized paper so the notary has plenty of space to sign. Texas and it's huge stamps.
