My wife was approved the CR1 Visa she gets it next week, but sadly her Medical has expired what to do?

 My wife went to the interview yesterday it only took 45 minutes for the whole thing. She was asked a few question like where I work and live and what I do. She was granted the Visa however, sadly the consular officer told her the Visa will be granted  and she can get it next week but there is a small problem. He says the medical has expired as it was done 9 months ago and medicals are valid for only 6 months.Has any body ever been in such situations. what will happen am very curious to know?

Seem it was done too early as the medical is only valid for six months.  redo as soon as possible and submit to embassy.

 

My Journey

Priority Date: July 24, 2007 (EAC)

AOS fee paid: February 2013

Request embassy change: May 2013

Son born: September 2013 (added to petition March 2014)

Interview: March 17, 2015 (Joint sponsor needed)

Joint sponsor documents submitted: April 27, 2015

Visas approved and issued: April 30, 2015. Had to return to embassy to do oath for son :)

Applied for SSNs: March 28, 2016 (didn't tick box on DS-260)

SSN received: April 4, 2016;

Learner's permit: April 7, 2016 (in NY you also have to do 5-hour class);

Driver's License: July 13, 2016 (on first try) :dancing:

Married: September 2015

I-130 sent: October 8, 2015 (via USPS)

Priority date: October 9, 2015 (WAC)

Petition approved: March 8, 2016 (5 months to the date of receipt) :)

NVC Welcome Letter: May 13, 2016
AOS documents sent: August 8, 2016
Case complete: September 14, 2016 (the waiting continues:clock:).

Interview:  October 5, 2017 (Approved - Issued following day :))

Visa in hand:  October 12, 2017

POE:  October 13, 2017

Green card:

You need to wait till you get the passport back. If the visa is issued then it must have a visa expiry date and it cannot be in the past. I don't see how they can issue the visa if the medical is expired. So wait for passport and then move from there.

  • Scan date: April 14/ May 7th (NVC said both I dont know why)

Well, visa does not guarantee any entry to the country. Only the BCP officer can decide whether or not she's eligible to enter. They will ask for medical and there will be a huge problem as she will be deny her entry based on her expired medical. Again, visa does not grant a 100% entry. Contact the embassy or lawyer. I think she has to do a new medical.

She will have to do a new medical.

At POE they check your medical files to make sure they are in date and by an approved doctor.

The embassy should be able to guide you.

Met 6/21/15 Online

Married since February 29th 2016 In the Netherlands (Where she is from)

6/12/16 - Preparing to send packet to USCIS

6/27/16 - Sent Package to Chicago lock-box via UPS

7/5/16 - NOA1 Text/Email / sent to Potomac (Hardcopy 7/10/16)

8/3/16 - NOA 2 I-130 Approved! Case sent to NVC! (Hardcopy 8/6/16)

8/19/16 to 9/4/16 - Visited wife for two weeks in NL. =}

9/1/16 - NVC Case and invoice # received. (Email) Finished DS260 and Paid AOS Fee.

9/8/16 - IV Fee Paid!

9/16/16 - DS260 Finished!

9/27/16 - Sent Documents to NVC.

11/21/16 - Called NVC. Case reviewed and accepted on 11/18. Waiting for email/mail.

11/28/16 - Got Email stating we are now waiting for an interview spot!

12/11/16 - Got the interview date! 1/12/17!

1/12/17 - ...ACCEPTED SHE IS NOW WAITING FOR HER PASSPORT IN THE MAIL! =]

1/18/17 - Passport and visa in her hands! We now wait till 2/24 for her to fly to me! (Has to finish work contract)

2/24/17 - She is now here with me! POE was simple,she only took 10 minutes with them checking her visa! "Welcome to America,missus"

3/15/17 - SSN Card Received.

4/10/17 - Greencard Received.

 

Preparing I-751 (ROC)

11/26/18 - I-751 Prepared and mailed out.

11/27/18 - UPS Confirmed Delivery at 10:30AM

12/3/18 - Checks cashed and got Email/Text With Receipt #

01/3/19 - Extension letter received.

There are only a few countries where visas expire based on the date of the medical exam.  If the consulate said they will issue the visa and kept the passport, take them at their word.  The visa will NOT be issued with an expiration date in the past.

 

What makes you think, 1, that the medical is expired? and 2, that it will make any difference?

Agreed. It doesn't. But it still wouldn't make sense because without a valid medical your can't get the visa either.
