GC holder stayed overseas more than 2 years and bring my wife with me on b1/b2 visa

thats not meaning i m married to her to keep her safe in my country.

i m not that silly to do that after living in usa around 4 years without staying out of the usa more than 45 days.

i did not intent to stay in my home country but what can i do and  as i said before my situation has changed when my wife's family was against to us and won't accept my wife back.

would you marry a person just to keep him/her safe in your country do you think is it only the reason why people getting married ? if i did not love her i would not be here and write asking advice.

u got good advice.  everyone tell u ur wife can not come to US to AOS but u no believe.  us don't like answer.  go apply for sb1 and see what happen.

Guys i m not here to argue or being rude to anyone.

i am tryting to get out of my stiuation right now if i can.

well all i understand is i can try to apply sb1 visa ( if i am approved) then i can petiton for my wife which will take up to 5 years.

during this time she has to stay in here while i am processing her papers from usa then without me she will also lose her residency in my country as well.

i know you guys will say that i m not even granted for my sb1 visa but those are the scenario so i want to know what i will be facing.

thanks for all of your effort to answer my questions.

Just a minor correction... If you apply for a spousal visa it will take about 2 years. Not 5.

You do have a choice, but you are ignoring everyones advice and seem to think for some reason you are special and dont need to follow the rules and are entitled to have it your way.

İ am not ignoring anyones advice.

but i do not like that people say i am trolling in here playing around nobody knows which situation we have been through or facing its easy to judge.

And making disrespectful comments i wish some of you will have the Same problems as me especially who making such a comment about me what i am dealing then lets see how it feels. 

 

Tell me who Said some possitive things for me well i know people trying to be "honest" for Their comments..

I don't understand what is the problem for your wife to go back to her country and wait for her petition being approved and processed in her own country? Of course, if you are accepted to be a US resident again. Your wife is an adult person and her country Russia is not North Korea, if she can't wait in your country, easy she goes to her own country, her own language, she can work there and live waiting to be approved, she doesn't need her parents help, many single women or single mothers live and work in Russia. I don't see any tragedy here. If you need to do all the immigration well and correct, do it the right way

Her father a military officer i can not describe all here so just guess what i mean she wont have a life There bec of her father since she is 4 months pregnant how i can send her back while she has nobody And father will be prevent to her to set up something new like finding a job And shelter russians are cold nation There is not Much family ties... is There any man who will let his own Wife go where she can face abuse or life danger which also carry a baby ? Well i m can not risk thats why i am here to find out what i can do but i guess nothing really .Thanks to all  i m not expecting that anyone will understand my situation

The USCIS link related to SB1 visas was provided.  If you, the applicant, can not today show that you qualify for a stand-alone immigrant visa then you do not qualify for an SB1 either.  Absent a petition, or someone who can file a petition, your case based on the rules appears from here to be DOA.

The application to determine this was also provided.  Fill it out, schedule an interview, and talk to the CO.  Bring your tax returns that we are all sure you have been faithfully filing and the bank account records for the US bank that we are all sure that you have been using and proof of the US address that we are all sure you have been maintaining and proof of all the property that we are all sure you left in the US with you because they want to see that stuff first.  Good luck.

OP PM'd  me but nothing added that is relevant.

 

Some key issues as many different things have become confused.

 

  1. As has been mentioned several times it would take a couple of years assuming the  OP is a LPR and can sponsor his spouse.
  2. Spouse is 4 months pregnant and presumably he does not want to leave her?
  3. Mention of Home Country but not where it is, may be pertinent.
  4. B Visa for wife seems unlikely bearing in mind no ties to home country, little to OP's country, where it becomes relevant which country it is. And she is 4 months pregnant.
  5. I usually prefer just hopping on a plane and seeing what happens ot the PoE, not sure how practical this bearing in mind that would mean leaving pregnant wife behind.
  6. Asylum was mentioned, see no basis and how would she get to the US anyway.

Sounds very unlikely she would get a Tourist Visa so you need to have a plan B, she can not go back to Russia so will you leave her in Turkey?

İf i will leave her in turkey she can have also problem without me being here as well she has residence bec of me i am afraid they Could take it away from her .

 

when i came to turkey first And we married i was about to go back but first needed to make her paper work in turkey but i am not working she needs Health care And i have to be sponsor her expenses i did all but took some time i am able to Show some documents from my heart problem but thats not gonna count good evidence so 

 

what i was thinking to get her a tourist visa  then apply sb 1 for me if we both approved which seems hard because they could reach my information in the system And will be a red flag then could take an asylum to her once she arrives to usa bec she has nowhere to go.
