My sister came here as K-1 visa, she have a child but didnt put her name when she applied for K-1 before.  Now she wanted her child to come here.  What kind of petition she have to file?  What paperwork she needs?

Any advice will be much appreciated.

  1. Was the child listed on the I-129F? If not, this can be a problem. Why wasn't the child listed?
  2. When was her K-1 issued?
  3. How old was the child when she married her petitioner (assuming she has already)?
  4. How old is the child now?
  5. Is she still married to the petitioner?

She will have to admit she lied on her I-129F.  That is NOT a good thing.  Why didn't she put her child on the original submittal?

 

This can backfire badly.  Where is she in her process?  Does she have AOS or GC yet?

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

She doesn't complete the I-129F the petitioner does .. and it is not a deal killer.

You don't mention how long ago your sister completed the K-1.. this is a factor.   Just the same ... 

 

As some have pointed out, and as the I-129F instructions stipulate.. list ALL children, whether immigrating or not.   The child was not listed I gather so not sure if the embassy will allow a FOLLOW TO JOINT with a K-2, I would suggest you contact the embassy regarding this before doing anything else  (you are not the first to omit listing a child).  I would not rule out them accepting the child as a K-2 as long as they can complete the visa process with one year of the K-1 visa being issued.     Worse case if the embassy does not allow the K-2, your husband files an I-130 for the child.    No worries either way.  ;)

That was my concern.  She should have listed all kids whether they were included in the petition or not.

There is more that needs to be known.  Did the petitioner know about the child at the time he filed?  If he didn't and it was a relatively short timeline from meeting to marriage then it could be looked at as plain old fraud.

HE should have listed the children in the I-129F .... the petitioner completes the the form.    If she never informed him of the child that is another story... and a long reach with an assumption.

Indeed. I stand corrected, sir! If he knew about the child, the child should have been included in th I-129F.
