How to fill I-130 for unemployed husband?

Hi, everyone. My husband in U.S. has been doing assistant at ceramic studio for a year, he'd had looked after his parents before that and they both passed away. 

He is unemployed and he's living with their investment of stock, heritage and property. He has a daughter so his household is three I guess. 

My question is should he write down "Unemployed" on his current job history? Do we need to fill form I-864 at the same time as filing I-130?

If he is not currently working, studying or retired then he must write "unemployed". 

 

The I-864 comes much later.

 

Yoir husband needs to read the full instructions that accompany the I-130 before completing it and sending it. The fact that you don't know that the I-864 is not needed yet suggests to me that either you or your husband (or both) have not read the instructions. There could be something else that you are not aware of so please have him read through all the instructions on the I-130 page on the USCIS website. It's important that you get everything right first time.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

If he is unemployed, enter unemployed.

 

It is not clear to me who is the US Citizen.  The I-130 is filed by the US Citizen, in behalf of their foreign spouse.  It's critical the US Citizen becomes an A-Student of the form instructions.  It's OK, if the foreign spouse helps etc. but it is the Petitioner's responsibility to make sure it's done properly.

 

Are you the US Citizen or the foreign spouse?
