Timeline

Hi everyone,

 

I submitted form I-130 & I-485 back in July, with 2 check payments. I made sure that all the information on the checks are correct. I got the receipts & I even went & got my biometrics appointment  completed. Only to find out from my bank that they closed my account (as we are a new customer to this bank, & somehow they weren't able to confirm my wife's SSN.) I then realized that this is the same bank account which the checks for USCIS were written from. The amount hasn't been withdrawed from USCIS yet. 

 

I begged the bank to reopen the account, but they couldn't, as it was permanently closed. I called USCIS 1800 number, and the lady said I should not be worried, just wait for a letter in the mail asking for a new check.

 

I now just received a letter "Notice of Rejection" along with all of my documents. I really need help. Do you think I can send the new checks with the same documents that were sent back to me? Or do I need to send a completely new paperworks? I will type the letter that I received below for you. Has anyone been in the same situation? Any inputs is much appreciated. Thank you so much in advance!!

 

"This notice is to inform you that USCIS has rejected the application or petition listed above because:

 

The check or money order submitted as payment was returned by the bank of financial institution.

 

Because you payment was not honored  by the bank, you must pay a $30.00 service fee. 

 

USCIS will take no further action on your rejected application or petition. You must submit a new application or petition along with a new filinf fees and supporting documents to request the benefit.

 

If you have quaestions about your rejected application or petition, call the USCIS Customer Service center at...."

Keep calm :) You just need to issue a new check and send with those untouched petition papers. Make sure to check the paperwork to see that they have not been marked in any ways by USCIS.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

Completely agree with @Going through, but let me make you a question...did you make an exact copy of the package that you sent originally? Because since I also have my first package returned to me, I know that it come completely dismantled and I felt like it would take me forever to organize it again and put it i in order to send it back...so I decided to make a new package, because I had all the filled forms saved on my computer and beside I had an exact copy of the package that I originally sent...it took me a day and a half I think to put it all together again (I recheck everything and actually found some ridiculous errors so I think it worth it)...I saved the package that they sent me (including the envelope), minus the green letter that came with it and sent a new package...but not before making a copy of this one as well.

Thank you so much for your inputs. Sorry to be repetitive, but I'm freaking out & I really think I need to complete a whole new application, with reasons below. Could you all review my thoughts & let me know what you think? 

 

1. All the forms which got sent back have these series of numbers & codes marked on them, on the bottom of all the pages. I think they scanned all of my documents? (With the first page being sharpied/ black marked over the number.)

2. On form I485, the top right box that is for USCIS Use Only has a Receipt number Label taped on, but this label has also been sharpied/ black marked over.

3. The letter says: USCIS will take no further action on your rejected application or petition. You must submit a new application or petition along with a new filing fees and supporting documents to request the benefit.

 

Hi GabiMatch,

I did make copies of the original documents that I sent. Luckily package seems to be in order, except for them being all being coded on & then marked over with sharpie ( I think this means my application gets cancelled out.)

May I ask you the following questions:

1. It seems like you went through the same thing that I'm going through (bounced check?) - Did you have your biometrics done twice? (I have mine done already, but if I'm submitting a whole new application, then I imagine I will have to get it done again?

2. If I understand you correctly, you submitted a whole new application, and you mentioned that you had a green letter. My letter (the notice of rejection) isn't green, I wonder if mine is the same form that you received... Did you include the green form when you submitted the new application?
