Hi , I was married in Philippines in 2010  and my ex husband and me got divorced here in Texas in 2016 .And now I am with my boyfriend and we have a family now and he ask me to marry him since we're building a family but then I'm afraid to say yes because I don't know if I'm allowed to or not . What exactly i needed to do .

If you're legally divorced, then you should be okay marrying your boyfriend. Also, marry him if you're ready to get married again.

No, you can marry anyone you want as long as your are legally divorced.

You are free to marry your bf as long as you are legally divorced.  It does not matter if you are USC or GC holder.  If your marital status is single/divorced then you can get married.

If you have the divorce papers then you are legally able to remarry. Now to have your marriage and divorce recognized legally in the Philippines that's a whole different set of issues. We can enlighten you with your options for having your divorce recognized in the Phil but we will need additional details.

Since you initiated the divorce then you are unable to have it adjudicated in the Philippines showing that you are divorce. A Filipino cannot initiate the divorce.  If you had your husband initiate the divorce then you could have filed in the Philippines and cleared your "name".  It sucks I know. But you can divorce and remarry anywhere in the world but not in the PI. So don't worry about it and enjoy your new love (and marry him) and live happy ever after.

If your EX initiates the divorce then you can clear things up in the Philippines. If not, then you still can remarry anywhere in the world except the Philippines.  Now keep in mind that you will need to start the paperwork in the Philippines (it can take time and money) with the intent of filing the USC initiated divorce.

 

I think Hank_ will weigh in on this topic. He is a little more knowledgeable then I am on this topic. Wait till he chimes in. I think he is still in the Phil so he won't be awake and on for a few more hours. The guy needs his beauty sleep. AND lots of it. :jest:
