Hello im a filipino citizen but a resident of south korea i was married in the phil. But divorced here and i met my american fiance and were planning to file k 1.  Will my previous marriage harm my application since i hadnt report our divorce in phil? We r not plannin to live in the phil anyways

If I remember it right, divorce is not legal in PH. You need to file for annulment if you married a filipino citizen as well. If you were married to a foreigner but got married in PH, I think you can get divorced in your spouses home country but have to report it in PH. Don't rely on what I say though. Best to talk to a lawyer who knows the legal procedure.

Divorce does not exist in PH, but that's irrelevant for US immigration. The US embassy will follow US law and recognize any legally-obtained divorce regardless of where it was obtained.

do you mean to say, you were married in the philippines (husband no. 1), left husband 1 without legally getting annulled when you moved to south korea and then while living in south korea you met husband no. 2, got married and then got divorced husband husband no. 2? or is husband 1 and 2 the same person?

Folks.... let get something straight off the bat. Their is a divorce in the Philippines but for a Filipino to use it for a visa they must have been married into the muslim faith and divorced through sharia court. Then and only then will USEM recognize that divorce.

 

Now for the OP. All you need is your divorce papers from your Japan divorce. You take it to the interview and present to the CO during your interview. US government will recognize it and you will be good to go.

You are GOLDEN!   You will need a copy of the final divorce decree (translated into English) for the visa petition at USCIS & visa process at the embassy.
