CR1 Visa process in Slovakia

Hello

I was living with my boyfriend for an year in the US and this year we got engaged. When we were going back to Slovakia to tell my parents, on the way back to the US they stopped me at CBP and denied my ESTA because i was spending too much time in US and i was engaged. 

Immidietly we got married and filed for CR1 visa.

I didnt change name yet and plan to do it after process is done as well as registering the marriage in my country - as it might create a mess in the files we have filed

i am wondering how long time it can take in Slovakia (europe) to have the interview and if it matters if I change my surname after the process is done? 

is there any other way i can visit my husband if my esta was denied and cr1 is in the process?

If you overstayed a lot on your ESTA (sounds like you did, a lot , if you spend a year in the US even though you're allowed 90 days), you might want to check if you don't have a ban. If you do, your CR1 visa will be denied on the interview and you will need a waiver.

 

If you don't have a ban, you can try to apply for the B2 visa to visit. But your chances are close to 0 at this point.

Hello- thanks for respond,  but no. there is misscomunication- I never said I overstayed ESTA in my post neither I have a ban. What I said is, that my esta was DENIED, because they said I spend TOO MUCH TIME in the US (like I travel there a lot) , and that I need proper visa for fionce. 

To this issue is my question. Not to the ban or overstaying...

Your green card will be in the  name you currently have. If you want to use your married name I suggest you do that now.  You can send in the forms with your married name even if you have no ID in that name. Get your passport changed while you wait on the USCIS approval (about 6-8 months). When you get to NVC you can will submit the new passport with the married name. The green card will only be printed in the name in the passport and it's expensive process to get that changed after the process. 

 

CR1 visa process takes on average 12 months.
